{"id":89898,"date":"2023-02-08T15:51:00","date_gmt":"2023-02-08T21:51:00","guid":{"rendered":"https:\/\/milesfortis.com\/?p=89898"},"modified":"2023-02-08T15:51:00","modified_gmt":"2023-02-08T21:51:00","slug":"89898","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=89898","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/www.ammoland.com\/2023\/02\/gop-senators-offer-short-act-to-stop-gun-owner-harassment\/#axzz7slTnomi0\" target=\"_blank\" rel=\"noopener\">GOP Senators Offer \u2018SHORT\u2019 Act to Stop Gun Owner \u2018Harassment\u2019<\/a><\/p>\n<p><strong>U.S.A.<\/strong>\u00a0\u2013<a href=\"https:\/\/www.ammoland.com\/\" target=\"_blank\" rel=\"noopener\" data-uri=\"47ea1ba96682f451592b08247d5de767\">-(AmmoLand.com)-<\/a>\u00a0Seventeen U.S. Senators\u00a0<a href=\"https:\/\/www.marshall.senate.gov\/newsroom\/press-releases\/sens-marshall-and-kennedy-rep-clyde-reintroduce-short-act-to-roll-back-atfs-new-pistol-brace-rule%ef%bf%bc\/\" target=\"_blank\" rel=\"nofollow noopener\" data-uri=\"638d0b2b1b4685289961afc4b4652e67\">recently introduced<\/a>\u00a0legislation aimed at removing the guts of the National Firearms Act\u2014taxation, registration and regulatory requirements\u2014and they are calling it the Stop Harassing Owners of Rifles Today (SHORT) Act.<\/p>\n<p>Sponsored by Sens. Roger Marshall (KS) John Kennedy (LA), John Barrasso (WY), John Boozman (AR), Ted Budd (NC), Mike Crapo (ID), Ted Cruz (TX), Steve Daines (MT), Cindy Hyde-Smith (MS), Mike Lee (UT), Cynthia Lummis (WY), Markwayne Mullin (OK), Rand Paul (KY), Mike Risch (ID), Mike Rounds (SD), Rick Scott (FL), John Thune (SD), and Tommy Tuberville (AL), the six-page measure may have a short life span\u2014it probably will not get out of the Senate with Democrats in control\u2014but it might raise a few eyebrows and some important political issues.<\/p>\n<div class=\"code-block code-block-17\">\n<div id=\"div-gpt-ad-1671218810065-0\" data-google-query-id=\"CO6nxaLzhv0CFcyqAAAdUOYPrA\">\n<div id=\"google_ads_iframe_\/22702991301\/ammoland_multisize_textad_0__container__\"><span style=\"font-size: 23px; font-weight: 900;\">It\u2019s the second go-round for this legislation. Marshall introduced it in the last Congress. But what about the issues it raises?<\/span><\/div>\n<\/div>\n<\/div>\n<p>In a report from\u00a0<a href=\"https:\/\/kidotalkradio.com\/idaho-senators-gun-rights\/?fbclid=IwAR0HHzSIX0eSaTq4jJdwJsX1Ybk6EHDLhe6XRFl6WEv3SS6ewBfcFcbxx3w\" target=\"_blank\" rel=\"nofollow noopener\" data-uri=\"9d202a746ad02c94542e752ae4038615\">KIDO Radio<\/a>\u00a0in Boise, Crapo and Risch both took nasty swipes at the Biden administration.<\/p>\n<blockquote><p><em>\u201cThis Administration\u2019s vendetta against lawful gun ownership is a gross violation of Constitutional rights. A federal gun registry has no place in America, yet this Administration is forcing millions of law-abiding Americans to either register these commonly owned firearms or become felons,\u201d Risch said.<\/em><\/p><\/blockquote>\n<p>\u201cAs the Biden Administration continues to seek creative methods of advancing their anti-gun agenda, Congress must be resolute and oppose all efforts to undermine Second Amendment rights,\u201d Crapo added. \u201cBurdening law-abiding Americans with additional firearm restrictions is not the answer to safeguarding the public.\u201d<\/p>\n<p><!--more--><\/p>\n<h3>Marshall also went after the administration, zeroing in on the new ATF pistol brace rule, which has already resulted in legal action.<\/h3>\n<blockquote><p>\u201cFinalization of this pistol brace rule represents the worst fears of gun owners across the country,\u201d Marshall observed in a prepared statement. \u201cThe SHORT Act will protect Americans from the anti-2nd\u00a0Amendment gun registry that the ATF is abusing the National Firearms Act to create. This Congress, I challenge my colleagues in both chambers to make protecting Americans\u2019 Second\u00a0Amendment Rights a priority and sign onto this legislation that will stop the ATF\u2019s pistol brace rule in its tracks.\u201d<\/p><\/blockquote>\n<p>The introduction of the SHORT Act came about two weeks after the\u00a0<a href=\"https:\/\/www.saf.org\/saf-rips-atf-final-rule-on-armbraces-lawsuit-will-move-forward\/\" target=\"_blank\" rel=\"noopener\" data-uri=\"0de4c43e2fc854e19534644aa85d4fc9\">Second Amendment Foundation<\/a>\u00a0had ripped into the administration for allowing the ATF to adopt its \u201cfinal rule.\u201d SAF already has a legal challenge in the works, filed way back in 2021. The case is known as\u00a0<em><a href=\"https:\/\/www.saf.org\/wp-content\/uploads\/2021\/01\/Complaint.pdf\" target=\"_blank\" rel=\"noopener\" data-uri=\"43f1f0cf1a677562afcf91ad86bbcf86\">SAF et. al. v. BATFE, et. al<\/a><\/em><a href=\"https:\/\/www.saf.org\/wp-content\/uploads\/2021\/01\/Complaint.pdf\" data-uri=\"43f1f0cf1a677562afcf91ad86bbcf86\">.<\/a><\/p>\n<blockquote><p>\u201cWhen we started this process,\u201d Gottlieb said at the time, \u201cwe anticipated where the agency\u2019s efforts would lead. With our\u00a0co-plaintiffs, we will continue to challenge this new arm brace rule.\u201d<\/p><\/blockquote>\n<p>SAF is joined in that case by Rainier Arms, LLC and two private citizens, Samuel Walley and William Green.\u00a0The lawsuit was filed in U.S. District Court for the Northern District of Texas, Dallas Division.<\/p>\n<blockquote><p>According to plaintiffs\u2019 attorney Chad Flores\u2019 analysis of the 291-page Final Rule, the definition of a \u201crifle\u201d now turns on a bewildering\u00a0six-factor test. This new definition can be controlled not by the firearm\u2019s objective characteristics, but instead\u00a0by what ATF agents in D.C. think of a manufacturer\u2019s marketing materials or the firearm\u2019s \u201clikely use.\u201d \u00a0The\u00a0new rule itself is forced to admit its dramatic result: Under this new definitional regime, \u201ca majority of the\u00a0existing firearms equipped with a \u2018stabilizing brace\u2019 are likely to be classified as \u2018rifles.\u2019\u201d<\/p><\/blockquote>\n<p>All of this comes at a coincidental moment, as SAF has\u00a0<a href=\"https:\/\/www.saf.org\/saf-launches-2023-gun-rightstv-ad-campaign\/\" target=\"_blank\" rel=\"noopener\" data-uri=\"a3762220eb29ed7f6e52c380dddacbf9\">just launched<\/a>\u00a0its 2023 television advertising campaign, in which President Joe Biden\u2019s own admission he wants to ban 9mm pistols, as well as semiautomatic rifles, is the centerpiece of the 60-second message.<\/p>\n<p>&nbsp;<\/p>\n<div class=\"rll-youtube-player\" data-src=\"https:\/\/www.youtube.com\/embed\/qF1HkklMLrM\" data-id=\"qF1HkklMLrM\" data-query=\"\">\n<div data-id=\"qF1HkklMLrM\" data-query=\"\" data-src=\"https:\/\/www.youtube.com\/embed\/qF1HkklMLrM\"><img loading=\"lazy\" decoding=\"async\" class=\"entered lazyloaded\" src=\"https:\/\/i.ytimg.com\/vi\/qF1HkklMLrM\/hqdefault.jpg\" alt=\"\" width=\"480\" height=\"360\" data-lazy-src=\"https:\/\/i.ytimg.com\/vi\/qF1HkklMLrM\/hqdefault.jpg\" data-ll-status=\"loaded\" \/><button class=\"play\" aria-label=\"play Youtube video\"><\/button><\/div>\n<\/div>\n<p>&nbsp;<\/p>\n<p>This is already causing trouble in Connecticut, where\u2014according to a Monday\u00a0<a href=\"https:\/\/www.saf.org\/saf-files-for-emergency-tro-in-challenge-of-conn-gun-law\/\" target=\"_blank\" rel=\"noopener\" data-uri=\"bcbf83870d358fd2863439ace72c1e7c\">announcement by SAF<\/a>\u2014legal action is heating up because that state\u2019s gun laws, combined with the ATF\u2019s new \u201crifle\u201d definition, makes criminals out of thousands of Constitution State citizens.<\/p>\n<p>SAF and its partners in a federal lawsuit against Connecticut Gov. Edward Lamont and several others have filed an\u00a0<a href=\"https:\/\/www.saf.org\/wp-content\/uploads\/2023\/02\/28-2023-02-3-Emergency-Mot-For-TRO_PI.pdf\" target=\"_blank\" rel=\"noopener\" data-uri=\"de1fcbc0887e8e629d59ed508b2b3e50\">emergency motion<\/a>\u00a0for a temporary restraining order because a new rule published by the federal Bureau of Alcohol, Tobacco, Firearms and Explosives on firearms designation places thousands of Constitution State citizens in serious legal jeopardy. SAF is joined by the Connecticut Citizens Defense League and three private citizens, Jennifer Hamilton, Michael Stiefel and Eddie Grant, Jr. They are represented by Connecticut attorneys Doug Dubitsky of North Windham, Craig C. Fishbein of Wallingford and Cameron L. Atkinson of Harwinton.<\/p>\n<blockquote><p>\u201cWhen ATF published its new rule,\u201d Gottlieb said, \u201credesignating a class of firearms known as \u2018any other firearm\u2019 or simply \u2018others\u2019 as either \u2018rifles\u2019 or \u2018short barreled rifles\u2019 depending on the barrel length, all of those guns suddenly fell within the state\u2019s definition of an assault weapon. This immediately put thousands of owners of previously-classified \u2018other\u2019 firearms in harm\u2019s way legally because now their possession is a felony.\u201d<\/p><\/blockquote>\n<p>SAF Executive Director Adam Kraut, who is also a practicing attorney, added this observation:<\/p>\n<blockquote><p>\u201cThis re-classification, is a textbook example of the harm which can be caused by an arbitrary change of rules and definitions making legally-purchased firearms suddenly illegal, turning their owners into criminals, essentially by the stroke of a pen.
