Republicans threaten to defund Biden gun rule that aims to reclassify pistols with braces as rifles<\/a><\/p>\n

ORLANDO, Fla.\u00a0\u2014\u00a0Republican\u00a0lawmakers vowed Tuesday to defund any attempt by the Biden administration to enforce a new\u00a0gun control rule that would reclassify pistols with stabilizing braces as short-barreled rifles.<\/p>\n

Under a new\u00a0Bureau of Alcohol, Tobacco, Firearms and Explosives\u00a0rule \u2014 \u201cFactoring Criteria for Firearms with Attached Stabilizing Braces\u201d \u2014 gun owners\u00a0who\u00a0have a stabilizing brace attachment on their firearm must register the device by May 31 or face up to 10 years in prison and thousands of dollars in fines.<\/p>\n

But Republican House lawmakers, gathered in Orlando this week for their annual\u00a0GOP retreat<\/a>, are lining up behind an effort to block the administration \u2014 and one said there will be no money in the budget produced by the Republican-controlled House to enforce the rule, which took effect Jan. 31.<\/p>\n

Rep. Andrew Clyde is pushing a resolution checking the administration, introduced almost a week ago, and already\u00a0has 182 Republican cosponsors. He told The Washington Times that federal\u00a0agencies are engaged in a power grab.<\/p>\n

<\/p>\n

\u201cThe ATF has overstepped its bounds significantly. They\u2019re not a legislative arm of the government,\u201d the Georgia Republican said.<\/p>\n

\u201cThey\u2019re an executive arm. And when they legislate, which is what they\u2019re\u00a0doing, redefining\u00a0a definition, then they have exceeded their authority.\u201d<\/p>\n

Mr. Clyde\u2019s resolution is expected to pass easily\u00a0in the House, but similar legislation from Republican Sens. John Kennedy of Louisiana and Roger Marshall of Kansas is expected\u00a0to hit a wall in the Democrat-controlled Senate.<\/p>\n

Mr. Clyde said Republicans\u00a0will find a way to \u201ctake it down\u201d anyway.<\/p>\n

\u201cWe\u2019ll defund the rule in appropriations. There\u2019s multiple ways of taking this unconstitutional rule down, and we\u2019re going to use every solitary one of them, because it\u2019s wrong. Imagine not knowing about it. And in 120 days, becoming a felon.\u201d<\/p>\n

Under the rule,\u00a0If gun owners\u00a0fail to\u00a0register their firearms\u00a0by the deadline,\u00a0they\u00a0will have to\u00a0destroy the\u00a0weapon, surrender\u00a0it\u00a0to the ATF or remove the brace in such a way that it cannot be reattached.<\/p>\n

Gun rights activists want to see Republicans go one step further and defund the ATF altogether. Citizens Committee for the Right to Keep and Bear Arms released a statement Monday.<\/p>\n

\u201cClearly,\u201d CCKRB Chairman Alan Gottlieb said, \u201cBiden and the Democrats have decided that American gun owners are their enemy. They are scrambling to restrict the Second Amendment rights of tens of millions of citizens whose only offense is that they want to exercise their right to keep and bear arms. Last week, the president signed an executive order to create even more restrictions. Where does this stop?\u201d<\/p>\n

\u201cThe only way to derail this obsession,\u201d he stated, \u201cis for House and Senate Republicans to send a message to the White House and Capitol Hill Democrats by refusing to fund the agency Biden wants to unleash on law-abiding Americans. This war on the Second Amendment must stop now.\u201d<\/p>\n

House Republicans will hold a joint hearing combining panels from Judiciary and Oversight scrutinizing the ATF on Thursday intended to probe the agency\u2019s new stabilizing pistol brace rule among many other actions the department has taken related to Americans\u2019 Second Amendment rights.<\/p>\n","protected":false},"excerpt":{"rendered":"
