THE HORROR<\/a><\/p>\n<p>When laws are challenged, they\u2019re challenged on constitutional grounds. Is this law in keeping with the Constitution or is this a case of legislative overreach?<\/p>\n<p>In fact, lawmakers are supposed to at least consider such things before passing laws. After all, they swear to support and defend the Constitution, which one would imagine requires them to consider it at a minimum before passing some bill.<\/p>\n<p>But it seems that the folks at the Huffington Post are upset that lawmakers are considering court rulings before passing gun control. They made\u00a0<a href=\"https:\/\/bearingarms.com\/tomknighton\/2023\/03\/13\/huffington-post-laments-bruen-preventing-gun-control-n68337\" target=\"_blank\" rel=\"noopener\">this pretty clear recently<\/a>.<\/p>\n<p>In fact, they\u2019re so upset,\u00a0<a href=\"https:\/\/www.huffpost.com\/entry\/courts-strangling-gun-reform_n_64188ad4e4b0bc5cb651b610\" target=\"_blank\" rel=\"noopener\">they said it all over again<\/a>.<\/p>\n<blockquote><p><strong>Left In The Legislative Lurch<\/strong><\/p>\n<p>Eight more states have laws similar to California\u2019s assault weapons ban that could be affected if the Supreme Court ultimately weighs in.<\/p>\n<p>The expectation that these laws may be doomed is already complicating the politics of passing new ones like them.<\/p>\n<p>In New Mexico, Democratic Gov. Michelle Luj\u00e1n Grisham has repeatedly urged the legislature to send her an assault weapons ban to sign this session, but\u00a0<a class=\" js-entry-link cet-internal-link\" role=\"link\" href=\"https:\/\/www.huffpost.com\/entry\/new-mexico-assault-weapons_n_640bab44e4b0584b47480363?kf2\" target=\"_blank\" rel=\"noopener\" data-vars-item-name=\"lawmakers tabled the effort\" data-vars-item-type=\"text\" data-vars-unit-name=\"64188ad4e4b0bc5cb651b610\" data-vars-unit-type=\"buzz_body\" data-vars-target-content-id=\"https:\/\/www.huffpost.com\/entry\/new-mexico-assault-weapons_n_640bab44e4b0584b47480363?kf2\" data-vars-target-content-type=\"buzz\" data-vars-type=\"web_internal_link\" data-vars-subunit-name=\"article_body\" data-vars-subunit-type=\"component\" data-vars-position-in-subunit=\"5\">lawmakers tabled the effort<\/a>\u00a0\u2014 partly over concerns that it wouldn\u2019t withstand scrutiny in federal court.<\/p>\n<p>\u201cThere\u2019s absolutely no point to passing new laws which federal courts will strike down and which are clearly going to be deemed unconstitutional,\u201d state Sen. Joseph Cervantes, a Democrat, tweeted last month.<\/p>\n<p>With those lawsuits still playing out, the future of gun policy remains in flux. But that legal panorama makes it hard to imagine clear lanes for reform in the near future.<\/p>\n<p>\u201cWe\u2019re in a very difficult spot with that Bruen ruling,\u201d said Miranda Viscoli, co-president of New Mexicans to Prevent Gun Violence. \u201cEven though it was only about concealed carry, it\u2019s just made everybody afraid who wants to pass common sense gun violence prevention legislation.\u201d<\/p><\/blockquote>\n<p>Now, in fairness, this is only one part of a much longer piece lamenting the rulings and the impact they\u2019re having on gun control.<\/p>\n<p>Still, it\u2019s interesting that they\u2019re still complaining about states not passing gun control because they figure it\u2019ll be tossed by the courts.<\/p>\n<p>I\u2019m sorry, that\u2019s not a bug. It\u2019s a feature.<\/p>\n<p>Huffington Post can be big mad all they want, but the truth of the matter is that gun control\u00a0<em>isn\u2019t<\/em>\u00a0constitutional. The author tries to get hung up on the militia clause at one point\u2013a matter that has been thoroughly and completely debunked\u2013and then laments the text and history test laid down in Bruen, but at no point can they actually make a legitimate case that gun control is within keeping behind the text or spirit of the Second Amendment.<\/p>\n<p>That\u2019s unsurprising, of course.<\/p>\n<p>I\u2019m glad to see legislatures hold up a bit before infringing on people\u2019s rights. I\u2019m upset that they\u2019re only starting to do it just now, but this is a case of better late than never.<\/p>\n<p>If they\u2019re holding up, that\u2019s great, but as the piece also notes, a lot of places aren\u2019t. In truth,\u00a0<em>that<\/em>\u00a0is the real problem, not those exercising a bit of caution and, dare I say, common sense.<\/p>\n<p>Then again, it\u2019s Huffington Post.
