The State says Mr. Busse\u2019s testimony is relevant to whether the firearms at issue are covered by the plain text of the Second Amendment. State\u2019s Opp. at 9. But as established above, that is an open-and-shut question. And while Mr. Busse includes some discussion of the features of so-called \u201cassault weapons\u201d he does not opine on whether those features represent a \u201cdramatic technological change\u201d that would allow the State to engage in the \u201cmore nuanced approach.\u201d\u00a0<\/em><\/p>\n<p><em>The State also exposes its shocking ignorance about the very firearms it regulates when it attempts to equate only caliber with power, while suggesting both of those are apparently unrelated to velocity. Every child in this country at some point learns Newton\u2019s second law, which is that force equals mass times acceleration. The caliber of a bullet pertains to its mass (though is not totally determinative of it, as .223 and .22LR have similar calibers but very different projectile weights), and the speed at which a particular mass moves determines how forcefully it impacts the intended target. <\/em><\/p>\n<p><em>It is not Plaintiffs\u2019 \u201cview\u201d that .223 Remington is one of the weaker centerfire cartridges. It is an indisputable fact that it is. That is why, as Plaintiffs showed in their motion, a handful of states actually banned .223 for deer hunting out of fear it was not powerful enough to reliably kill a deer, unlike far more powerful common centerfire rifle rounds like .308. (Virginia argued that their caliber regulation is necessary because the use of rifles of a caliber less than .23 to dispatch deer would result in an unacceptable number of crippled wounded and\/or lost deer.).\u00a0<\/em><\/p>\n<p><em>Mr. Busse knows all of this. On his Twitter account on\u00a0<a href=\"https:\/\/twitter.com\/ryandbusse\/status\/1544334684456247298\" target=\"_blank\" rel=\"noopener\">July 5, 2022<\/a>, he explained that \u201cthe typical hunting\u00a0<a title=\"This is an affiliate ad link.\" href=\"https:\/\/www.avantlink.com\/click.php?tt=ale&amp;ti=11297&amp;pri=9659&amp;pw=275597&amp;mi=16365&amp;url=https%3A%2F%2Fwethepeopleholsters.com%2F\" target=\"_blank\" rel=\"noopener ugc,nofollow\">gun<\/a>\u00a0fires a much larger bullet (might be 200 grains or more) some at similarly [to .223] fast speeds. Those rifles are technically MUCH more powerful than an AR15.\u201d Just this week, on\u00a0<a href=\"https:\/\/twitter.com\/ryandbusse\/status\/1646178717222445056\" target=\"_blank\" rel=\"noopener\">April 12, 2023<\/a>, Mr. Busse similarly tweeted that \u201cThe AR15 does not fire particularly high-power rifle rounds when compared to single rounds of most hunting rifles. Single .223\/5.56 cartridges of the AR15 are only fractionally \u2018as powerful\u2019 as a cartridge like the .30-06.\u201d Perhaps Plaintiffs should have retained Mr. Busse to rebut Mr. Busse.<\/em><\/p>\n<div class=\"td-a-rec td-a-rec-id-content_inline  tdi_2_414 td_block_template_1\">\n<div id=\"wh_17415148_1\" class=\"ads_container\">\n<div id=\"ld-13777902496068710-703\"><em>Given his knowledge, his effort to deceive this Court by comparing the centerfire .223 round to the far weaker rimfire .22LR, a much slower and smaller round typically used for hunting small game or low-recoil target shooting, demonstrates Busse\u2019s unreliability as an expert witness.\u00a0<\/em><\/div>\n<div><\/div>\n<\/div>\n<\/div>\n<p>\u2014\u00a0<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cacd.676380\/gov.uscourts.cacd.676380.145.0.pdf\" target=\"_blank\" rel=\"noopener\">Plaintiffs\u2019 reply<\/a>\u00a0to defendants\u2019 opposition to motions to exclude expert testimony in\u00a0<a href=\"https:\/\/michellawyers.com\/rupp-v-becerra\/\" target=\"_blank\" rel=\"noopener\">Rupp v.
