{"id":91998,"date":"2023-04-19T16:41:54","date_gmt":"2023-04-19T21:41:54","guid":{"rendered":"https:\/\/milesfortis.com\/?p=91998"},"modified":"2023-04-19T16:41:54","modified_gmt":"2023-04-19T21:41:54","slug":"91998","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=91998","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/thereload.com\/nebraska-legislature-passes-permitless-gun-carry\/\" target=\"_blank\" rel=\"noopener\">Nebraska Legislature Passes Permitless Gun-Carry<\/a><\/p>\n<p>The Cornhusker State is now one signature away from becoming the 27<sup>th<\/sup>\u00a0to adopt permitless gun carry.<\/p>\n<p><span data-preserver-spaces=\"true\">The Nebraska legislature voted 33-14 to pass\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.nebraskalegislature.gov\/FloorDocs\/108\/PDF\/Final\/LB77.pdf\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Legislative Bill 77<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0on final reading Wednesday morning. The bill would allow adults aged 21 and over who would otherwise be eligible for a concealed carry permit to carry a firearm in public without obtaining one. The bill now goes to Governor Jim Pillen\u2019s (R.) desk, where he is expected to sign it into law.<\/span><\/p>\n<p>\u201cI am proud to support LB 77 and Nebraskans\u2019 constitutional rights,\u201d Pillen\u00a0<a href=\"https:\/\/twitter.com\/TeamPillen\/status\/1648727969492357120\">said<\/a>\u00a0shortly after the bill\u2019s passage. \u201cThank you to the Nebraska Legislature for sending this bill to my desk.\u201d<\/p>\n<p><span data-preserver-spaces=\"true\">Once signed, the bill will add another feather in the cap of gun-rights advocates who have successfully pushed the policy in states across the country over the last two decades. The bill will make Nebraska the second state to adopt permitless carry this year, following\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/thereload.com\/florida-governor-desantis-signs-permitless-gun-carry-into-law\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Florida\u2019s adoption earlier this month<\/span><\/a><span data-preserver-spaces=\"true\">, and the 26th state to enact the policy in the last 20 years. Vermont has had the policy since its founding.<\/span><\/p>\n<p>The bill\u2019s passage led to a familiar call and response among activists on either side of the issue.<\/p>\n<p>Gun-rights advocates immediately celebrated.<\/p>\n<p>\u201cWith Gov. Pillen\u2019s signature, Nebraska becomes the 27th state in America that protects the right of Americans to carry a firearm outside of their home without first asking the government for additional permission and paying additional fees,\u201d Travis Couture-Lovelady, the Nebraska state director for the NRA, said in a press release. \u201cNebraska is the latest state to recognize law-abiding citizens are not the problem \u2014 criminals are.\u201d<\/p>\n<p>While gun-control advocates denounced the bill as an affront to public safety.<\/p>\n<p>\u201cNebraska lawmakers have chosen to put politics over protecting our families,\u201d Jen Hodge, a member of the Nebraska chapter of Moms Demand Action, said. \u201cOver the past few weeks, tens of thousands of young people across the country, and here in Nebraska, walked out of school to demand action on gun safety by their representatives, but instead, Nebraska lawmakers are actively stripping away safety measures.\u201d<\/p>\n<p><span data-preserver-spaces=\"true\">But the bill also represents a significant victory for state Senator Tom Brewer (R.), the bill\u2019s prime sponsor, who has tried for years to get permitless carry across the finish line in Nebraska. His 2022 permitless carry bill\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/governor.nebraska.gov\/press\/unfinished-business-enhancing-nebraska%E2%80%99s-commitment-protecting-second-amendment-rights#:~:text=Under%20constitutional%20carry%2C%20law%2Dabiding,a%20permit%20to%20carry%20concealed.\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">narrowly failed<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0in the state\u2019s unicameral legislature after falling just two votes short of overcoming a Democratic filibuster. However, state Republicans made gains in the chamber last November and\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/omaha.com\/news\/local\/govt-and-politics\/balance-of-power-in-nebraska-legislature-tips-in-favor-of-republicans\/article_c6f2a82c-5bb3-11ed-8194-7fa51b3e303c.html\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">now have a filibuster-proof majority<\/span><\/a><span data-preserver-spaces=\"true\">. That cleared the way for Wednesday\u2019s successful final vote.<\/span><\/p>\n<p>\u201cA person in Nebraska should not have to pay money to the government in order to exercise a constitutional right,\u201d Brewer\u00a0<a href=\"https:\/\/nebraskapublicmedia.org\/en\/news\/news-articles\/legislature-opens-debate-on-permitless-concealed-carry-bill\/\">said<\/a>.<\/p>\n<p>While the bill would do away with permitting requirements for gun carry, it would not alter who is eligible to carry or obtain a firearm. Those, such as convicted felons, who can\u2019t legally purchase or possess a firearm under state and federal law would not be allowed to carry under the permitless law. It also would not change where people are allowed to carry.<\/p>\n<p>In addition to doing away with permitting requirements for gun carry, the bill would strengthen Nebraska\u2019s preemption statute by removing the authority of local governments to enact gun regulations that are stricter than state law.
