Town officials said Banyai built structures on his land without applying for any zoning permits.<\/p>\n<p class=\"p3\">In 2021 Banyai\u00a0<a href=\"https:\/\/apnews.com\/article\/ny-state-wire-shootings-business-gun-politics-c28092be0da198c2bb465ecc5562e35d\" target=\"_blank\" rel=\"noopener\">told the Associated Press<\/a>\u00a0his property, which he calls Slate Ridge, is a \u201csafe and environmentally friendly place for people to discharge their firearms.\u201d<\/p>\n<p class=\"p3\">None of that mattered to Pawlet town officials. After their initial zoning efforts failed, they sued Banyai in Vermont\u2019s Environmental Court, which ordered him to remove the unpermitted structures and earthen berms within 135 days. Banyai ignored the ruling, and in February the Environmental Court held Banyai in contempt of court. He has been racking up civil fines at the rate of $200 per day ever since.<\/p>\n<p class=\"p3\">\u201cRespondent has demonstrated a willfulness, perhaps even an enthusiasm, for disregarding the Town\u2019s Bylaws, this Court\u2019s Orders, and the authority of the Judiciary,\u201d Vermont Environmental Court Judge Thomas Durkin said in his order.<\/p>\n<p class=\"p3\">Attempts to contact Banyai for this story were unsuccessful.<\/p>\n<p><!--more--><\/p>\n<div class=\"td-pb-row\">\n<div class=\"td-pb-span8 td-main-content\" role=\"main\">\n<div class=\"td-ss-main-content\">\n<div class=\"td-post-content tagdiv-type\">\n<h3 class=\"p3\"><b>Lawfare<\/b><\/h3>\n<p class=\"p3\">After municipal and environmental laws failed, town officials approached Vermont State Senator Phillip Baruth for help. He quickly sponsored a bill making it a felony to operate a \u201cparamilitary training camp\u201d within the state.<\/p>\n<p class=\"p3\">Baruth, a liberal Democrat from Burlington, admitted he introduced the bill after Pawlet officials complained there was no state law that they could use to force Banyai to shutter his private ranges on his private property.<\/p>\n<p class=\"p3\">This week, Vermont\u2019s Gov. Phil Scott \u2013 a Republican \u2013 signed the bill into law.<\/p>\n<p class=\"p4\"><em>\u00a7 4071. PARAMILITARY TRAINING PROHIBITED<\/em><\/p>\n<p class=\"p4\"><em>(a) A person shall not:<\/em><\/p>\n<p class=\"p4\"><em>(1) teach, train, or demonstrate to any other person the use, application, or making of a firearm, explosive, or incendiary device capable of causing injury or death, or techniques capable of causing injury or death to persons, if the person knows or reasonably should know that the teaching, training, or demonstrating is intended to be used in or in furtherance of a civil disorder; or<\/em><\/p>\n<p class=\"p4\"><em>(2) assemble with one or more other persons for the purpose of practicing or being taught, trained, or instructed in the use, application, or making of a firearm, explosive, or incendiary device capable of causing injury or death, or in techniques capable of causing injury or death to persons, if the person knows or reasonably should know that the practicing, teaching, training, or instruction is intended to be used in or in furtherance of a civil disorder.<\/em><\/p>\n<p class=\"p3\"><span class=\"s2\"><a href=\"https:\/\/uscode.house.gov\/view.xhtml?path=\/prelim@title18\/part1\/chapter12&amp;edition=prelim\" target=\"_blank\" rel=\"noopener\">United States Code<\/a><\/span>\u00a0defines a civil disorder as \u201cany public disturbance involving acts of violence by assemblages of three or more persons, which causes an immediate danger of or results in damage or injury to the property or person of any other individual.\u201d<\/p>\n<p class=\"p3\">The new law does not apply to \u201clegitimate law enforcement activity,\u201d or \u201ceducational institutions where military science is taught.\u201d It also doesn\u2019t apply to \u201c<a href=\"https:\/\/www.thetruthaboutguns.com\/get-training-reasons-seek-firearm-self-defense-training\/\" target=\"_blank\" rel=\"noopener\">self-defense instruction<\/a>\u00a0or practice without the intent of causing a civil disorder; firearms instruction that is intended to teach the safe handling and use of firearms; and any lawful sports or activities like hunting, target shooting and firearms collection.\u201d<\/p>\n<p class=\"p3\">Anyone who violates the paramilitary training law faces up to five years in prison and a $50,000 fine.<\/p>\n<p class=\"p3\">As you can imagine, the\u00a0<a title=\"This is an affiliate ad link.\" href=\"https:\/\/www.avantlink.com\/click.php?tt=ale&amp;ti=11297&amp;pri=9659&amp;pw=275597&amp;mi=16365&amp;url=https%3A%2F%2Fwethepeopleholsters.com%2F\" target=\"_blank\" rel=\"noopener ugc,nofollow\">gun<\/a>\u00a0ban industry celebrated the new legislation.<\/p>\n<p class=\"p3\">\u201cToday, Vermont joins 25 other states that prohibit firearms training for anti-government paramilitary activity,\u201d Allison Anderman, senior counsel and leader of Giffords\u2019 Guns &amp; Democracy project said in a statement. \u201cPrivate paramilitary activity is illegal in Vermont and has been associated with the intimidation of people exercising their constitutional rights across the US. This is a commonsense policy that will help reduce the spread of dangerous, illegal, and anti-government firearms intimidation.\u201d<\/p>\n<h3 class=\"p3\"><b>High potential for abuse<\/b><\/h3>\n<p class=\"p3\">Vermont\u2019s new law and others like it are \u2013\u00a0<i>by design\u00a0<\/i>\u2013 so overly broad and vague they could easily be used to force almost any private range out of business. It\u2019s all about the definitions. After all, we\u2019ve seen how one man\u2019s political protest can become another\u2019s\u00a0<a href=\"https:\/\/www.thetruthaboutguns.com\/the-media-are-working-hard-to-whip-up-talk-of-armed-insurrection-ahead-of-the-2022-and-2024-elections\/\" target=\"_blank\" rel=\"noopener\">insurrection<\/a>.<\/p>\n<p class=\"p3\">Nowadays, what\u2019s antigovernment? It\u2019s no secret Joe Biden isn\u2019t popular among many range-goers. Do RSOs now need to search vehicles for\u00a0<i>Let\u2019s Go Brandon<\/i>\u00a0bumper-stickers?<\/p>\n<p class=\"p3\">What constitutes paramilitary training? Would teaching gunfighting rather than target shooting violate the law? How about Tac-Med classes or a mini-SERE course? How long before IPSC, IDPA or 3-<a title=\"This is an affiliate ad link.\" href=\"https:\/\/www.avantlink.com\/click.php?tt=ale&amp;ti=11297&amp;pri=9659&amp;pw=275597&amp;mi=16365&amp;url=https%3A%2F%2Fwethepeopleholsters.com%2F\" target=\"_blank\" rel=\"noopener ugc,nofollow\">Gun<\/a>\u00a0competitions are banned?<\/p>\n<p class=\"p3\">How is a firearms instructor supposed to know whether their students intend to use their training<i>\u00a0in furtherance of a civil disorder<\/i>? Should they interrogate their students about their\u00a0<a href=\"https:\/\/www.thetruthaboutguns.com\/72-of-americans-expect-political-violence-take-steps-to-protect-yourself-from-rioters-now\/\" target=\"_blank\" rel=\"noopener\">political beliefs<\/a>? Do they need to issue written loyalty oaths and recite the Pledge of Allegiance before the safety brief?<\/p>\n<p class=\"p3\">Besides, we\u2019ve all seen how the gun-banners and their sycophants in the legacy media pounce whenever they see a III-percenter patch or something similar at a pro-gun\u00a0rally. To them, the whole crowd instantly becomes extremists rather than law-abiding Second-Amendment supporters.<\/p>\n<p class=\"p3\">I don\u2019t know Mr. Banyai\u2019s politics and quite frankly I do not care.
