{"id":92873,"date":"2023-05-16T20:37:29","date_gmt":"2023-05-17T01:37:29","guid":{"rendered":"https:\/\/milesfortis.com\/?p=92873"},"modified":"2023-05-16T20:39:24","modified_gmt":"2023-05-17T01:39:24","slug":"92873","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=92873","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/www.nj.com\/news\/2023\/05\/gun-rights-advocates-win-major-challenge-to-njs-tough-concealed-carry-law.html\">Gun rights advocates win major challenge to N.J.\u2019s tough concealed carry law.<\/a><\/p>\n<p>A new <a class=\"\" href=\"https:\/\/www.nj.com\/politics\/2022\/12\/nj-strictly-overhauls-concealed-carry-gun-restrictions-as-murphy-signs-law.html\" target=\"_blank\" rel=\"noopener\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\">law limiting concealed carry of guns in New Jersey<\/a><span class=\"text-node\">\u00a0suffered another defeat in federal court Tuesday as a judge ordered state officials not to enforce its tight restrictions pending a flurry of legal challenges from gun rights advocates.<\/span><\/p>\n<p>The ruling means New Jerseyans with proper permits are free to concealed-carry handguns at beaches, public parks, bars and restaurants \u2014 places from where Gov.\u00a0<a class=\"\" href=\"https:\/\/www.nj.com\/topic\/phil-murphy\/\" target=\"_blank\" rel=\"noopener\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Phil Murphy\u00a0<\/span><\/a><span class=\"text-node\">and his Democratic allies in the state Legislature sought to ban firearms in an effort to curb gun violence.<\/span><\/p>\n<p>Following a U.S. Supreme Court decision last year that found restrictive concealed carry laws on the books in states like New York and\u00a0<a class=\"\" href=\"https:\/\/www.nj.com\/politics\/2023\/01\/judge-says-njs-concealed-gun-carry-law-does-not-apply-at-some-sensitive-places.html\" target=\"_blank\" rel=\"noopener\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">New Jersey violated the Second Amendment,<\/span><\/a><span class=\"text-node\"> Democratic leaders in the state fast-tracked a new measure that made it easier for citizens to obtain carry permits, but tightly limited where guns were allowed.<\/span><\/p>\n<div id=\"55KXT3NNRFBFTPJCFLOTGWTSF4\">But in a\u00a0<a href=\"https:\/\/archive.is\/o\/U2Ifq\/https:\/\/www.documentcloud.org\/documents\/23814242-nj_concealed_carry_injunction\" target=\"_blank\" rel=\"noopener\">235-page<\/a>\u00a0ruling made public Tuesday, U.S. District Court Judge Renee Marie Bumb officially put its enforcement on hold.<\/div>\n<div id=\"5VLJDVX5ZZHGPEQHI5D5LQ6TFM\">Gun rights advocates declared victory, praising the decision as a \u201csmackdown\u201d of \u201cdraconian laws.\u201d<\/div>\n<p><!--more--><\/p>\n<div id=\"AXXDHTUNANGWRGL7WY7LL2Z524\">Gov. Phil Murphy in a statement called the ruling a \u201cpoorly reasoned decision\u201d that \u201csends exactly the wrong message as our nation confronts another devastating wave of mass shootings that have taken the lives of many across our country, including children.\u201d<\/div>\n<div><\/div>\n<div id=\"7KZWEHNWPZA6DEWUIRGXTNBTQE\">New Jersey\u2019s top law enforcement officer, state Attorney General Matthew Platkin pledged to appeal the judge\u2019s ruling to a higher court, a process that could take weeks or months.<\/div>\n<div><\/div>\n<div id=\"DFJVTO26JNDDZB76O5564T65IU\">Bumb, a President George W. Bush appointee, sharply criticized state authorities, writing that New Jersey had \u201cfailed to offer any evidence that law-abiding responsible citizens who carry firearms in public for self-defense are responsible for an increase in gun violence.\u201d<\/div>\n<div><\/div>\n<div id=\"6GQNVRDD3JHBZL5WPVMY4U6L6U\">Issuing a preliminary injunction against the law, she wrote that even founding father Thomas Jefferson \u201cwould have warned against\u201d the law because it would disarm law-abiding citizens.<\/div>\n<div><\/div>\n<div id=\"MOVM623FFBBTTOKPNIALVF7CTQ\">Platkin, the state attorney general, assailed the decision as \u201cbad constitutional law,\u201d writing in a statement that the court \u201cnow insists that we are powerless to protect New Jersey residents, and proclaims that the Second Amendment requires allowing guns at parks and beaches, in libraries, at public gatherings, in zoos, and even in bars, among other sensitive places.\u201d<\/div>\n<div><\/div>\n<div id=\"YD4CR2EMMJEOJOVI3JEJRQT5RQ\">Those \u201csensitive places\u201d are at the center of the dispute.<\/div>\n<div><\/div>\n<div id=\"H3AT2R567FFSTPYVQJKC4NSZYU\">The law signed by Murphy in December listed an array of such locations where handguns could not be carried, prompting criticism from Second Amendment advocates that the measure included so many \u201csensitive places\u201d that it was impossible for permit-holders to avoid violating it.<\/div>\n<div><\/div>\n<div id=\"X4W3SKCKCBFXTDR5IG5R4UXVC4\">The legal challenge was brought by several concealed carry permit holders affiliated with New Jersey gun rights groups, including a man who obtained a permit after he was kidnapped and beaten in a bizarre case of mistaken identity.<\/div>\n<div><\/div>\n<div id=\"FORFTJ2CUBCORIE2UXM5GHBVJI\">The judge kept in place New Jersey\u2019s new system for obtaining a carry permit, finding the state\u2019s new requirements for firearms training did not conflict with the Second Amendment, which provides for reasonable restrictions on who can carry a gun.<\/div>\n<div><\/div>\n<div id=\"GHKGKNRIJFBJZGLRP3FRNDOINA\">A requirement that permit-seekers obtain insurance for their weapon was struck down, as well as a provision prohibiting people with permits from carrying their weapon on their person inside a vehicle.<\/div>\n<div id=\"JXUGMAOF2BFIDFLBS7OSQIOYLI\">Individual property owners are also permitted to prohibit guns from their property, a portion of the decision Platkin called \u201ca silver lining\u201d for gun control advocates.<\/div>\n<div><\/div>\n<div id=\"BMFJ2XUEUZBOBK723ZTWFZOD4Q\">\u201cNo one may carry a firearm inside someone else\u2019s home, or into a business closed to the public, without the owner\u2019s express permission,\u201d Platkin said, citing Bumb\u2019s ruling that kept that provision in place.<\/div>\n<div><\/div>\n<div id=\"MGEDB5SAM5F5HC3NC7OCMRUEJ4\">\u201cAnd for everyone else \u2014 for retail establishments and other businesses open to the public \u2014 the owners can still make clear that carrying firearms is not welcome on their premises, just as homeowners can make clear guns are unwelcome on their lawns and driveways,\u201d he said.<\/div>\n<div><\/div>\n<div id=\"EOUBKVHZTFCFXHBGQB3XNTDMVQ\">Alexander Roubian, president of one of the plaintiff groups, the New Jersey Second Amendment Society, said the group was \u201cecstatic Judge Bumb smacked down a majority of the discriminatory and draconian laws,\u201d claiming that restricting access to firearms disproportionately hurt women and minority permit-seekers.<\/div>\n<div><\/div>\n<div id=\"OBUGX27TLFAXXCUHNQMO3CLKDM\">He noted Platkin and Murphy, who both have State Police protection details, \u201csurround themselves with guns\u201d while seeking to limit the public\u2019s access to firearms.<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Gun rights advocates win major challenge to N.J.\u2019s tough concealed carry law.
