{"id":93320,"date":"2023-06-01T14:46:08","date_gmt":"2023-06-01T19:46:08","guid":{"rendered":"https:\/\/milesfortis.com\/?p=93320"},"modified":"2023-06-01T14:46:08","modified_gmt":"2023-06-01T19:46:08","slug":"93320","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=93320","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/newjerseymonitor.com\/briefs\/gun-rights-advocates-ask-judges-to-uphold-ruling-in-fight-over-gun-law\/\" target=\"_blank\" rel=\"noopener\">Gun rights advocates ask judges to uphold ruling in fight over gun law<\/a><\/p>\n<p><strong>Attorneys for Second Amendment advocates fighting New Jersey\u2019s new gun law are urging a federal appeals court to uphold a recent ruling blocking most of the law from taking effect.<\/strong><\/p>\n<p><span data-preserver-spaces=\"true\">State attorneys failed to prove anyone would be irreparably harmed by U.S. District Court Judge Ren\u00e9e Marie Bumb\u2019s\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/newjerseymonitor.com\/2023\/05\/16\/federal-judge-blocks-more-of-new-jerseys-new-concealed-carry-gun-law\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">order<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0earlier this month affirming people\u2019s right to carry guns in many places state lawmakers banned them, the lawyers wrote in two briefs filed Tuesday in response to the state attorney general\u2019s\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/newjerseymonitor.com\/2023\/05\/23\/state-appeals-federal-ruling-blocking-enforcement-of-new-gun-law\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">appeal of Bumb\u2019s order.<\/span><\/a><\/p>\n<p><span data-preserver-spaces=\"true\">Attorneys representing New Jersey gun owners Ronald Koons and Aaron Siegel filed separate challenges the day Gov. Phil Murphy\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/newjerseymonitor.com\/2022\/12\/22\/governor-murphy-signs-new-gun-restrictions-into-law\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">signed the law<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0in December. The cases were later consolidated.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">In two briefs totaling almost 60 pages, the attorneys repeatedly refer to\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/20-843_7j80.pdf\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Bruen<\/span><\/a><span data-preserver-spaces=\"true\">, the U.S. Supreme Court case that struck down restrictions on gun carry, as a reason why the state\u2019s bid to halt Bumb\u2019s preliminary injunction is \u201cflawed from start to finish,\u201d as Siegel\u2019s attorneys\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/newjerseymonitor.com\/wp-content\/uploads\/2023\/05\/5-30-23-Siegel-response.pdf\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">put it.<\/span><\/a><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cGovernments may bar the carrying of firearms in only \u2018exceptional circumstances,\u2019\u201d Koons\u2019 attorneys\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/newjerseymonitor.com\/wp-content\/uploads\/2023\/05\/5-23-23-Koons-response.pdf\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">noted,<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0citing Bruen. \u201cThe exception cannot become the rule.\u201d<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">In defending lawmakers\u2019 decision to ban guns in about 25 \u201csensitive places,\u201d the state failed to prove such prohibitions are \u201chistorically justified,\u201d as Bruen requires, Koons\u2019 attorneys added.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cThe state is left with speculative public-safety and public-confusion arguments,\u201d they wrote.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">But any ruling further altering the status quo would just add to\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/newjerseymonitor.com\/briefs\/as-concealed-carry-law-evolves-heres-where-you-can-and-cant-take-guns-in-new-jersey\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">public confusion<\/span><\/a><span data-preserver-spaces=\"true\">, they added.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Both briefs take aim at the new law\u2019s \u201canti-carry default,\u201d in which lawmakers banned guns on government and private property that is open to the public, such as stores, and guns loaded and within reach in vehicles. Private property owners have the right to forbid guns on their property, but the government can\u2019t make that decision for them, the attorneys argue. Bumb had enjoined both the private property and vehicle restrictions.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cTo the extent there is any ambiguity, it must be interpreted in favor of the Second Amendment,\u201d Koons\u2019 attorneys wrote.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">A spokeswoman from the Attorney General\u2019s Office declined to comment.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gun rights advocates ask judges to uphold ruling in fight over gun law Attorneys for Second Amendment advocates fighting New Jersey\u2019s new gun law are urging a federal appeals court to uphold a recent ruling blocking most of the law from taking effect.
