{"id":93332,"date":"2023-06-01T16:27:51","date_gmt":"2023-06-01T21:27:51","guid":{"rendered":"https:\/\/milesfortis.com\/?p=93332"},"modified":"2023-06-01T16:27:51","modified_gmt":"2023-06-01T21:27:51","slug":"93332","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=93332","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/www.newsmax.com\/michaeldorstewitz\/bruen-moore-unconstitutional\/2023\/05\/31\/id\/1121827\/\" target=\"_blank\" rel=\"noopener\">Most Gun Control Laws Render Us More Unsafe<\/a><\/p>\n<p>Every time Democrats unveil a new gun control proposal, their message is the same: their bill, if enacted, will save lives. Actually the exact opposite is true.<\/p>\n<p>States have recently rushed to pass new laws in response to a decision the U.S. Supreme Court made last year in New York State Rifle and Pistol Association vs. Bruen.<\/p>\n<p>It held that the Second Amendment prohibits government requiring applicants to prove a &#8220;special need&#8221; in order to be issued a concealed carry permit.<\/p>\n<p>States that included this requirement are called &#8220;may issue&#8221; states; others, which comprise the majority, are called &#8220;shall issue&#8221; states.<\/p>\n<p>Maryland was one of those &#8220;may issue&#8221; states, and concealed carry applications there soared in response to Bruen.<\/p>\n<p>&#8220;The Maryland State Police has received 11 times the usual number of new permit applications since the court struck down state provisions requiring gun owners to demonstrate a special need for carrying a firearm for self-defense,&#8221; The Washington\u00a0<a href=\"https:\/\/www.washingtonpost.com\/dc-md-va\/2022\/07\/15\/concealed-carry-maryland-guns-hogan\/\" rel=\"nofollow noskim\">Post reported<\/a>.<\/p>\n<p>However, to paraphrase a verse in the Book of Job: &#8220;the government giveth, the government taketh away.&#8221;<\/p>\n<p>Many &#8220;may issue&#8221; jurisdictions, including Maryland, scrambled to change their concealed carry laws to comply with Bruen, while still limiting the right to carry, despite the plain language of the Second Amendment that states &#8220;the right of the people to keep\u00a0<em>and bear<\/em>\u00a0arms shall not be infringed.&#8221;<\/p>\n<p>So while newly-elected Gov. Wes Moore, a Democrat, eased restrictions to obtain a permit, he simultaneously tightened them \u2014 by limiting the places where one may carry.<\/p>\n<p>&#8220;Gun violence is tearing apart the fabric of our communities, not just through mass shootings but through shootings that are happening in each of our communities far too often,&#8221;\u00a0<a href=\"https:\/\/www.cbsnews.com\/baltimore\/news\/maryland-governor-wes-moore-gun-control-bills-tightening-requirements-nra-lawsuit\/#:~:text=The%20Gun%20Safety%20Act%20of,to%20carry%20a%20concealed%20weapon.\" rel=\"nofollow noskim\">Moore said<\/a> at a bill-signing ceremony. &#8220;We will act, and that&#8217;s exactly what today represents.\u201d<\/p>\n<p>But by signing Maryland\u2019s new law, he only made Baltimore\u2019s \u201cmean streets\u201d even meaner.<\/p>\n<p><!--more--><\/p>\n<p>In response to the new restrictions, the Second Amendment Foundation (SAF), a national gun rights organization based in Bellevue, Washington, filed a federal lawsuit.<\/p>\n<p>&#8220;The main problem is that it really limits where you can carry your gun,&#8221; SAF founder and Executive Vice President\u00a0<a href=\"https:\/\/www.newsmax.com\/platinum\/second-amendment-gun-control-state-laws\/2023\/05\/23\/id\/1120834\/\">Alan Gottlieb told Newsmax<\/a>. &#8220;They\u2019re trying to imitate and mimic what New York and New Jersey did.&#8221;<\/p>\n<p>As he observed, &#8220;they\u2019ll issue a ticket, but once you have it, it\u2019s not good anyplace.&#8221; Accordingly, \u201cit puts a chilling effect on obtaining gun permits, What good is a permit if you can\u2019t use it?\u201d<\/p>\n<p>SAF filed a lawsuit challenging a similar New Jersey law, and recently won a preliminary injunction.<\/p>\n<p>&#8220;The Constitution leaves the States some measures to combat handgun violence,&#8221; U.S. District Court Chief Judge Renee Marie Bumb wrote in her\u00a0<a href=\"https:\/\/www.saf.org\/wp-content\/uploads\/2023\/05\/gov.uscourts.njd_.506033.124.0_1.pdf\" rel=\"nofollow noskim\">235-page ruling<\/a>, however, &#8220;to \u2018prevent law-abiding citizens with ordinary self-defense needs from exercising their right to keep and bear arms.&#8217; That is plainly unconstitutional.&#8221;<\/p>\n<p>A federal district court also struck down New York\u2019s restrictions \u2014 But Gottlieb acknowledges Maryland may be a tougher nut to crack \u201cbecause, quite frankly, they\u2019ve got a pretty good judge from their point of view.\u201d<\/p>\n<p>What\u2019s especially egregious about the new law is that in practice, it applies to only one class of individuals: the law-abiding citizen.<\/p>\n<p>Criminals aren\u2019t hampered by the restrictions \u2014 restrictions with which the law-abiding will comply in most cases.<\/p>\n<p>Last year a Greenwood, Indiana mall was the scene where a lawful concealed carry holder did not strictly comply with the law.<\/p>\n<p>Elisjsha &#8220;Eli&#8221; Dicken carried a firearm while shopping with his girlfriend, unaware that the mall was a no-gun zone.<\/p>\n<p>A gunman entered the same mall, armed with multiple weapons and multiple loaded magazines.<\/p>\n<p>He then walked to the mall\u2019s food court and opened fire.<\/p>\n<p>It came to an abrupt halt 15 seconds later when a Dicken shot and killed the gunman. But had he complied with the &#8220;gun-free&#8221; zone restriction, the outcome would have been far worse.<\/p>\n<p>&#8220;Many more people would have died last night if not for a responsible armed citizen that took action very quickly within the first two minutes of the shooting,&#8221;\u00a0<a href=\"https:\/\/www.newsmax.com\/newsfront\/gun\/2022\/07\/18\/id\/1079333\/\">said Greenwood police chief James Ison<\/a>\u00a0during a press briefing.<\/p>\n<p>The National Rifle Association agreed.<\/p>\n<p>&#8220;We will say it again: The only way to stop a bad guy with a gun is a good guy with a gun,&#8221; the NRA said on Twitter.<\/p>\n<p>But Gottlieb concluded that states like Maryland, New York and New Jersey want to remove that element of a &#8220;good guy with a gun.&#8221;<\/p>\n<p>&#8220;Now you\u2019re penalizing the permit-holders, and not the criminals,&#8221; he observed.<\/p>\n<p>As a result, the law \u201cis definitely making Maryland less safe, because it doesn\u2019t stop criminals from misusing guns. It only stops law-abiding people from defending themselves.\u201d<\/p>\n<p>An adage that was popular decades ago went: &#8220;when guns are outlawed, only outlaws will have guns.&#8221;<\/p>\n<p>It\u2019s just as true today as it was then.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Most Gun Control Laws Render Us More Unsafe Every time Democrats unveil a new gun control proposal, their message is the same: their bill, if enacted, will save lives.
