{"id":94334,"date":"2023-07-12T16:55:13","date_gmt":"2023-07-12T21:55:13","guid":{"rendered":"https:\/\/milesfortis.com\/?p=94334"},"modified":"2023-07-12T16:55:13","modified_gmt":"2023-07-12T21:55:13","slug":"94334","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=94334","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/bearingarms.com\/tomknighton\/2023\/07\/11\/biden-executive-order-3-n72443\" target=\"_blank\" rel=\"noopener\">Biden&#8217;s anti-gun executive orders falling one by one<\/a><\/p>\n<p>The purpose of an executive order is for the president to tell others in the executive branch precisely how they\u2019re to carry out the laws passed by Congress. It was never intended as a way to create laws without the legislature.<\/p>\n<p>However, President Joe Biden, like so many before him, does just that.<\/p>\n<p>Take gun control, for example. Biden can\u2019t pass it. Not like he wants. Congress just isn\u2019t interested in banning things like so-called ghost guns.<\/p>\n<p>So, Biden uses an executive order, directs the ATF to essentially declare them illegal, and calls it a day.<\/p>\n<p>Only,\u00a0<a href=\"https:\/\/thetexan.news\/biden-administrations-ghost-gun-rule-vacated-by-texas-based-federal-judge\/\" target=\"_blank\" rel=\"noopener\">that didn\u2019t work out<\/a>.<\/p>\n<blockquote><p><strong><span style=\"font-size: 12pt;\"><span style=\"color: #000000;\">Numerous federal gun control policies enacted by the<\/span>\u00a0<a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2022\/04\/11\/fact-sheet-the-biden-administration-cracks-down-on-ghost-guns-ensures-that-atf-has-the-leadership-it-needs-to-enforce-our-gun-laws\/\" target=\"_blank\" rel=\"noopener\">Biden administration<\/a>\u00a0<span style=\"color: #000000;\">via executive order have faced extensive scrutiny in federal courts with jurisdiction over matters arising in Texas, the latest being a\u00a0<\/span><a href=\"https:\/\/www.justice.gov\/opa\/pr\/frame-and-receiver-rule-goes-effect\" target=\"_blank\" rel=\"noopener\">rule implemented last year<\/a>\u00a0<span style=\"color: #000000;\">seeking to regulate home-build firearms kits.<\/span><\/span><\/strong><\/p>\n<p><strong><span style=\"font-size: 12pt;\"><span style=\"color: #000000;\">Texas residents Jennifer VanDerStok and Michael Andren, along with the\u00a0<\/span><a href=\"https:\/\/www.firearmspolicy.org\/vanderstok\" target=\"_blank\" rel=\"noopener\">Firearms Policy Coalition (FPC), challenged the new rule<\/a>\u00a0<span style=\"color: #000000;\">expanding the definition of a \u201cfirearm receiver\u201d to include kits that contain partially manufactured parts and are marketed to be completed into functioning firearms, which are also referred to as \u201cghost guns.\u201d<\/span><\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\"><strong><span style=\"font-size: 12pt;\">The Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) issued a statement when the rule was published last year, explaining that it was prompted by a proliferation of untraceable guns without serial numbers from being used in crimes. The ATF claimed it would help prevent those prohibited by law from obtaining a gun, such as convicted felons, from easily obtaining one.<\/span><\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\"><strong><span style=\"font-size: 12pt;\">The ATF claimed there were 692 instances of ghost guns being used in homicides or attempted homicides.<\/span><\/strong><\/span><\/p><\/blockquote>\n<p>Of course, from what we\u2019ve seen, those 692 instances were spread out over a significant period of time, meaning that they\u2019re a statistical drop in the bucket when looking at so-called gun deaths.<\/p>\n<p>But this wasn\u2019t the only example of Biden\u2019s executive orders showing signs of trouble.<\/p>\n<p>There\u2019s trouble brewing for Biden\u2019s other big-ticket executive order,\u00a0<a href=\"https:\/\/bearingarms.com\/camedwards\/2023\/06\/30\/fifth-circuit-panel-appears-skeptical-of-atf-pistol-brace-rule-n72133\" target=\"_blank\" rel=\"noopener\">the ban on pistol braces<\/a>. There\u2019s already some judicial skepticism and the membership of the Second Amendment Foundation and the Firearms Policy Coalition are already exempt from it by court order.<\/p>\n<p>In fact, it\u2019s so bad it\u2019s not unreasonable to ask whether\u00a0<em>any<\/em>\u00a0of Biden\u2019s executive orders will stand.<\/p>\n<p>Oh, I\u2019m sure a few will.\u00a0<a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2023\/03\/14\/fact-sheet-president-biden-announces-new-actions-to-reduce-gun-violence-and-make-our-communities-safer\/#:~:text=gun%20industry%20accountable-,The%20Executive%20Order%20directs%20the%20President's%20Cabinet%20to%3A,will%20fall%20into%20dangerous%20hands.\" target=\"_blank\" rel=\"noopener\">Parts of this order<\/a>\u00a0are just about speeding up the process of collecting data the government already collects, which isn\u2019t likely to be overturned.<\/p>\n<p>But that same executive order also deals with the so-called rogue gun dealers who appear to just be FFL holders who make administrative errors, and that is likely to end up in court sooner or later. Based on what we\u2019ve seen, that\u2019s going to be bad news for the Biden administration.<\/p>\n<p>At the end of the day, most of Biden\u2019s executive orders will probably be overturned, but not without a lot of time and resources spent fighting this power grab.<\/p>\n<p>And none of it should be happening. The truth is that the legislative branch is who should be passing laws, not the executive, but with Congress having basically turned a blind eye to the ATF\u2019s repeated \u201creinterpretations\u201d of gun control laws, we have the mess we\u2019re currently in.<\/p>\n<p>If only\u00a0<em>that<\/em>\u00a0would fall in court.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Biden&#8217;s anti-gun executive orders falling one by one The purpose of an executive order is for the president to tell others in the executive branch precisely how they\u2019re to carry out the laws passed by Congress.
