{"id":94384,"date":"2023-07-15T00:03:05","date_gmt":"2023-07-15T05:03:05","guid":{"rendered":"https:\/\/milesfortis.com\/?p=94384"},"modified":"2023-07-14T14:08:28","modified_gmt":"2023-07-14T19:08:28","slug":"94384","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=94384","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/www.saf.org\/saf-files-amicus-brief-supporting-challenge-of-hawaii-gun-law\/\" target=\"_blank\" rel=\"noopener\">SAF FILES AMICUS BRIEF SUPPORTING CHALLENGE OF HAWAII GUN LAW<\/a><\/p>\n<p>BELLEVUE, WA \u2013 The Second Amendment Foundation has filed a 29-page\u00a0<a title=\"\" href=\"https:\/\/www.saf.org\/wp-content\/uploads\/2023\/07\/Wolford-SAF-AMICUS-brief-for-tro.pdf\">amicus brief<\/a>\u00a0supporting a motion for a temporary restraining order and preliminary injunction in a challenge of Hawaii\u2019s restrictive concealed carry law, in a case known as\u00a0<a title=\"\" href=\"https:\/\/www.courtlistener.com\/docket\/67525716\/1\/wolford-v-lopez\/\">Wolford v. Lopez<\/a>.<\/p>\n<p>The brief was filed in U.S. District Court for the District of Hawaii.<\/p>\n<p>As explained in the court document, Hawaii \u201chas followed New York, New Jersey, and Maryland in taking deliberate action to undermine the Supreme Court\u2019s landmark Bruen ruling and the fundamental general right to carry an effective mechanism of self-defense it affirmed. Hawaii\u2019s SB 1230 and similar laws specifically, and unfairly target those who have taken their rights most seriously in attempting to exercise them, even submitting to Defendants\u2019 background check and training requirements.\u201d<\/p>\n<p>Following the 2022 Supreme Court ruling in New York State Rifle &amp; Pistol Association v. Bruen, Hawaii passed SB 1230, a sweeping law designed to severely limit the places where licensed, law-abiding citizens can legally carry firearms for personal protection. So restrictive in its nature, the new legislation was colloquially dubbed the \u201cBruen response bill.\u201d<\/p>\n<p>\u201cAs we contend in our brief,\u201d said SAF founder and Executive Vice President Alan M. Gottlieb, \u201cHawaii\u2019s new law is written to make citizens afraid to exercise their constitutional right to bear arms, to the point they\u2019re even afraid to enter a coffee shop without first being invited. We cannot have law-abiding citizens afraid to exercise a right for fear of being prosecuted and made into criminals. That is not how constitution works, and specifically, it is why the Second Amendment includes the phrase \u2018shall not be infringed.\u2019 SB 1230 constitutes a serious infringement.\u201d<\/p>\n<p>\u201cThere are no historical analogues supporting the extreme nature of Hawaii\u2019s gun law,\u201d added SAF Executive Director Adam Kraut. \u201cTo the contrary, as we explain to the court, history shows lawmakers respected Second Amendment rights as part of everyday life, to the point of encouraging people to bring their guns to public meetings and even church.
