(<a href=\"https:\/\/www.koin.com\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-type=\"URL\" data-id=\"https:\/\/www.koin.com\/\">KOIN<\/a>) \u2013 Oregon\u2019s\u00a0<a href=\"https:\/\/www.koin.com\/news\/elections\/oregon-measure-114-latest-11092022\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-type=\"URL\" data-id=\"https:\/\/www.koin.com\/news\/elections\/oregon-measure-114-latest-11092022\/\">Measure 114<\/a>\u00a0is constitutional, according to a\u00a0ruling by the U.S. District Court for the District of Oregon.<\/p>\n<p>The federal court ruled in Oregon\u2019s favor in a lawsuit against the gun control measure approved by voters by a slim margin in 2022. The ruling means the state may ensure Oregonians get a permit before obtaining firearms, require a state police-maintained permit\/firearm database and prohibit \u201clarge capacity\u201d ammunition magazines.<\/p>\n<p>There is an exception for military and law enforcement.<\/p>\n<p>The measure describes \u201clarge capacity\u201d magazines as \u201cfixed\/detachable magazines (or functional equivalent) that can accept \u2018more than 10 rounds of ammunition and allows a shooter to keep firing without having to pause to reload.\u2019\u201d The measure also includes exceptions for \u201c\u2019lever-action\u2019 firearms and permanently altered fixed magazines, 10 rounds or fewer.\u201d<\/p>\n<div class=\"nlp-ignore-block article-content rich-text\">\n<aside class=\"promo-link\">Since voters approved of the gun control measure, some have called it unconstitutional, claiming that it <a href=\"https:\/\/www.koin.com\/news\/oregon\/closing-arguments-claim-measure-114-violates-second-amendment\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-type=\"URL\" data-id=\"https:\/\/www.koin.com\/news\/oregon\/closing-arguments-claim-measure-114-violates-second-amendment\/\">violated the Second Amendment<\/a>. The disagreement focused primarily over whether high-capacity magazines are considered firearms or accessories.<\/aside>\n<\/div>\n<p>The plaintiff\u2019s attorney made the case that magazines are critical for the gun, so they should be considered arms, but attorneys defending Measure 114 argued that detachable magazines are accessories \u2013 not firearms \u2013 and don\u2019t affect the operability of the gun itself.<\/p>\n<p>In response to the measure\u2019s ruling, Jess Marks, the executive director of the\u00a0<a href=\"https:\/\/www.oralliance.org\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-type=\"URL\" data-id=\"https:\/\/www.oralliance.org\/\">Oregon Alliance for Gun Safety<\/a>, issued the following statement:<\/p>\n<blockquote class=\"wp-block-quote\"><p><span style=\"color: #000000;\"><strong><span style=\"font-size: 12pt;\">\u201cWe know Measure 114 is an effective and life-saving policy, and now a federal judge has ruled it is also in line with the U.S. Constitution. The Supreme Court has articulated that Second Amendment rights are not unchecked \u2014 they come with responsibilities \u2014 and the U.S. District Court affirmed this in our case. This victory belongs to those who have lost loved ones to gun violence and to every Oregonian who demanded change.\u201d<\/span><\/strong><\/span><\/p><\/blockquote>\n<div class=\"nlp-ignore-block article-content rich-text\">\n<aside class=\"promo-link\">However, the law is still on hold due to a ruling by a Harney County judge, but Oregon Attorney General Elken Rosenblum issued a statement Friday afternoon praising the decision.<\/aside>\n<aside><\/aside>\n<\/div>\n<p>\u201cOur team looks forward to ultimately prevailing in the state courts as well,\u201d she said. \u201cMeasure 114\u2019s provisions \u2013 passed by Oregon voters \u2013 are common sense safety measures that will save lives.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Federal court rules Measure 114 constitutional despite criticism The ruling (hold onto your hat for the legal acrobatics the judge used) PORTLAND, Ore.
