{"id":94468,"date":"2023-07-17T17:34:33","date_gmt":"2023-07-17T22:34:33","guid":{"rendered":"https:\/\/milesfortis.com\/?p=94468"},"modified":"2023-07-17T17:41:52","modified_gmt":"2023-07-17T22:41:52","slug":"94468","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=94468","title":{"rendered":""},"content":{"rendered":"<p>This is legal stonewalling by a judge who purposefully flips what SCOTUS ruled in Heller, Caetano and Bruen in what she hopes will take years of legal wrangling in the off chance that either or both Justices Alito and Thomas pass on and a demoncrap administration can appoint anti-gun Justices and get all these case law restorals of the 2nd amendment protections on RKBA undone&#8230;because the unwashed masses really shouldn&#8217;t have the means to tell goobermint where to go, and make it stick.<\/p>\n<p><a href=\"https:\/\/www.ammoland.com\/2023\/07\/federal-court-ruling-upholding-oregon-gun-law-will-be-appealed\/#ixzz87lMOBJeO\" target=\"_blank\" rel=\"noopener\">Federal Court Ruling Upholding Oregon Gun Law Will be Appealed<\/a><\/p>\n<p><strong>U.S.A.<\/strong>\u00a0\u2014 A federal district judge\u2019s ruling\u00a0<a href=\"https:\/\/www.oregonlive.com\/crime\/2023\/07\/federal-judge-finds-oregons-new-gun-control-measure-114-is-constitutional.html\" target=\"_blank\" rel=\"nofollow noopener\" data-uri=\"fe29d3e5db11b507397b0fd4c4e7e641\">upholding the constitutionality<\/a>\u00a0of Oregon\u2019s restrictive gun control Measure 114 will definitely be appealed, the head of the Second Amendment Foundation assured via email with a terse one-word statement.<\/p>\n<p><strong><span style=\"font-size: 12pt;\">SAF founder and Executive Vice President Alan Gottlieb, responding to an email inquiry asking, \u201cCertainly, there will be an appeal, right?\u201d responded bluntly: \u201cRight.\u201d<\/span><\/strong><\/p>\n<div class=\"code-block code-block-5\">\n<div id=\"div-gpt-ad-1681151398698-0\" data-google-query-id=\"CIS828jlloADFeE9swAdZVsDpA\">\n<div id=\"google_ads_iframe_\/22702991301\/Ammoland\/AL_In-Content_1_0__container__\">U.S. District Judge Karin Immergut, in a <a href=\"https:\/\/www.documentcloud.org\/documents\/23877421-immergutrulingoffmeasure114case\" data-uri=\"49686a645ef21f619be05bb0deb5a9ef\">122-page decision<\/a>, wrote, <em>\u201cPlaintiffs have not shown that the Second Amendment protects large-capacity magazines, defined as magazines capable of firing eleven or more rounds without reloading. And even if the Second Amendment were to protect large-capacity magazines, this Court finds that Defendants and Intervenor-Defendant have established that Oregon\u2019s restrictions on the use and possession of large-capacity magazines are consistent with the Nation\u2019s history and tradition of firearm regulation.\u201d<\/em><\/div>\n<\/div>\n<\/div>\n<div class=\"code-block code-block-17\">\n<div id=\"div-gpt-ad-1671218810065-0\"><\/div>\n<\/div>\n<p>The ruling was immediately blasted by the Oregon Firearms Federation (OFF), one of several plaintiffs challenging the law in a consolidation of four federal lawsuits, two of which involve SAF and several partners. In a scathing reaction, OFF declared Judge Immergut\u2019s ruling \u201cabsurd\u201d and further said her decision was \u201cagainst gun owners, the Second Amendment and a basic understanding of the English language.\u201d<\/p>\n<blockquote><p><span style=\"font-size: 12pt; color: #000000;\"><strong>Immergut\u2019s ruling does appear oblivious to facts involving firearms and self-defense when, on Page 120, she states,<em>\u00a0\u201cThe Supreme Court has held that Second Amendment protects an individual right to self-defense inside and outside of the home.\u00a0LCMs are not commonly used for self-defense,\u00a0and are therefore not protected by the Second Amendment.\u201d<\/em><\/strong><\/span><\/p><\/blockquote>\n<p><strong>This seems to ignore the prevalence of modern semi-automatic pistols, which are commonly used for personal protection, and which come from the factory with magazines holding more than 10 cartridges.<\/strong><\/p>\n<p>According to\u00a0<a href=\"https:\/\/thehill.com\/homenews\/state-watch\/4098803-judge-upholds-stringent-oregon-gun-control-law-as-constitutional\/\" target=\"_blank\" rel=\"nofollow noopener\" data-uri=\"47be72ce0d1e96924dd21855ad9892a0\">The Hill<\/a>, Oregon Attorney General Ellen Rosenblum <a href=\"https:\/\/www.doj.state.or.us\/media-home\/news-media-releases\/statement-from-ag-rosenblum-regarding-doj-victory-on-m114-in-federal-court\/\" target=\"_blank\" rel=\"nofollow noopener\" data-uri=\"f266a16e2f21f5589774c67f0c10b911\">praised<\/a>\u00a0the ruling while acknowledging the law still cannot be enforced because it is still being challenged in state court. A judge in Harney County has scheduled a trial in September. By that time, Judge Immergut\u2019s decision will likely have been appealed to the Ninth U.S. Circuit Court of Appeals in San Francisco.<\/p>\n<p>Rosenblum, a Democrat, was quoted by The Hill, stating, \u201cOur team looks forward to ultimately prevailing in the state courts as well.\u201d<\/p>\n<div class=\"code-block code-block-6\">\n<div id=\"div-gpt-ad-1681151438500-0\" data-google-query-id=\"CIW828jlloADFeE9swAdZVsDpA\">\n<div id=\"google_ads_iframe_\/22702991301\/Ammoland\/AL_In-Content_2_0__container__\">\n<div id=\"AmmolandDFPAdParallaxerCont_138437706172\">\n<div>\n<div>The four federal lawsuits, which were consolidated for this case, involved virtually every gun rights organization in the country. In addition to SAF and OFF, plaintiffs included the Firearms Policy Coalition, National Shooting Sports Foundation, Oregon State Shooting Association (an affiliate of the National Rifle Association), several private citizens, and at least three Oregon sporting goods retailers.<\/div>\n<div><\/div>\n<div><\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<p><!--more--><\/p>\n<p>The state lawsuit involves Gun Owners of America, the Gun Owners Foundation and various private citizens, as noted by the\u00a0<a href=\"https:\/\/centraloregondaily.com\/oregon-gun-control-measure-114-judge-constitutional\/\" target=\"_blank\" rel=\"nofollow noopener\" data-uri=\"cbe1063bd978ae53ff4eaa8d5eadb2e4\">Central Oregon Daily<\/a>. That lawsuit challenges the measure under the Oregon State Constitution.<\/p>\n<p>Measure 114 is described by the media as one of the strictest gun control laws in the country. It requires proof of safety training to purchase a firearm, requires a permit to purchase from a law enforcement agency, and bans magazines holding more than 10 cartridges\u2014which would include not only magazines for popular semiautomatic sporting rifles but also many, if not a majority, of popular semi-auto handguns, as noted above.<\/p>\n<div class=\"code-block code-block-7\">\n<div id=\"div-gpt-ad-1681151478485-0\" data-google-query-id=\"CIa828jlloADFeE9swAdZVsDpA\">\n<div id=\"google_ads_iframe_\/22702991301\/Ammoland\/AL_In-Content_3_0__container__\">Throughout her ruling, Judge Immergut\u2014a Donald Trump appointee\u2014sides consistently with the defendants and Measure 114.<\/div>\n<\/div>\n<\/div>\n<blockquote><p><span style=\"color: #000000;\"><strong><span style=\"font-size: 12pt;\">In its statement, OFF asserted,\u00a0<em>\u201cWe are sure there will be plenty of parsing of this absurd decision in the coming days, but it was clear from the very first day that Immergut was both painfully ignorant and in the pocket of Oregon\u2019s far left \u201cDepartment of Justice\u2026No doubt it took this long for her to come up with a reason to reach this conclusion when none of the facts were on her side.\u201d<\/em><\/span><\/strong><\/span><\/p><\/blockquote>\n<p>In the aftermath of Measure 114\u2019s\u00a0<a href=\"https:\/\/gov.oregonlive.com\/election\/2022\/general\/measures\" data-uri=\"f74d15be31daeb1420dbc1c124e82915\">narrow passage<\/a>\u00a0in November 2022 (50.6% in favor, 49.4% opposed), neighboring Washington state passed legislation earlier this year extending a 10-day waiting period to the purchase of all firearms, not just so-called \u201cassault weapons,\u201d which was part of Initiative 1639, passed by voters in 2018.<\/p>\n<p>It is unclear when SAF or any of the other plaintiffs in the four federal challenges will file appeals. Because the ruling was issued Friday, attorneys for those plaintiffs\u2014and there are lots of them\u2014are no doubt studying Judge Immergut\u2019s ruling. SAF is the only organization involved in two separate challenges of Measure 114.
