{"id":95282,"date":"2023-08-19T12:33:18","date_gmt":"2023-08-19T17:33:18","guid":{"rendered":"https:\/\/milesfortis.com\/?p=95282"},"modified":"2023-08-19T12:36:00","modified_gmt":"2023-08-19T17:36:00","slug":"95282","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=95282","title":{"rendered":""},"content":{"rendered":"<p>The court ruled that since the law hadn&#8217;t actually been enforced yet, the plaintiffs didn&#8217;t have &#8216;standing&#8217;, as they weren&#8217;t yet subject to harm.<\/p>\n<p><a href=\"https:\/\/www.shorenewsnetwork.com\/2023\/08\/18\/new-jersey-can-sue-gun-companies-as-a-public-nuisance-appeals-court-rules\/\" target=\"_blank\" rel=\"noopener\">New Jersey Can Sue Gun Companies As A \u2018Public Nuisance,\u2019 Appeals Court Rules<\/a><\/p>\n<p>The state of New Jersey can sue firearms manufacturers under a new state public nuisance law designed to target the industry, a federal appellate court ruled on Thursday.<\/p>\n<p>New Jersey, in July of 2022, enacted new statutory law that allows the attorney general to sue gun manufacturers for being a \u201cpublic nuisance\u201d if they have \u201cendangered the safety and health of New Jersey residents through the sale, manufacture, distribution, and marketing of lethal, but nonetheless legal, gun-related products,\u201d according to the\u00a0<a href=\"https:\/\/casetext.com\/statute\/new-jersey-statutes\/title-2c-the-new-jersey-code-of-criminal-justice\/chapter-2c58-registration-of-manufacturers-and-wholesale-dealers-of-firearms\/section-2c58-33-attorney-general-statutory-cause-of-action-public-nuisance-violations-certain\">law<\/a>. The state was then sued by the National Shooting Sports Foundation (NSSF) in November of 2022 in a \u201cpre-enforcement action,\u201d to stop them from bringing a suit under the law, which was on Thursday dismissed for a lack of ripeness \u2014 meaning that it hasn\u2019t matured to the point where a genuine dispute exists \u2014 according to the court\u2019s ruling\u00a0<a href=\"https:\/\/newjerseymonitor.com\/wp-content\/uploads\/2023\/08\/Shooting-Sports-Foundation-ruling.pdf\">dismissing<\/a>\u00a0the suit.<\/p>\n<p><strong>\u201cPre-enforcement challenges are unusual. To bring one, the plaintiff must show that the stakes are high and close at hand \u2026 Yet this suit falls far short of even the \u2018normal\u2019 pre-enforcement challenge. A brand-new civil tort statute, without more, does not justify a federal court\u2019s intervention,\u201d<\/strong> wrote U.S. Circuit Judge Stephanos Bibas, a Trump appointee to the U.S. Court of Appeals for the Third Circuit, for a unanimous three-judge bench. \u201c[W]e see little evidence that enforcement is looming \u2026 the Foundation has jumped the gun,\u201d Bibas noted.<\/p>\n<p>New Jersey\u2019s law was passed in response to the Supreme Court\u2019s ruling in <a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/20-843_7j80.pdf\">New York State Rifle &amp; Pistol Association v. Bruen<\/a>, where the court in a 6-3 ruling struck down a New York law that required pistol permit applicants to prove that a \u201cproper cause exists\u201d for having such a permit. The Supreme Court ruled that the law violated the Second Amendment.<\/p>\n<p>\u201cThe exercise of other constitutional rights does not require individuals to demonstrate to government officers some special need. The Second Amendment right to carry arms in public for self-defense is no different,\u201d wrote Justice Clarence Thomas for the majority in the case. The ruling was widely criticized by\u00a0<a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2022\/06\/23\/statement-by-president-joe-biden-on-supreme-court-ruling-on-guns\/\">Democrats<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.aclu.org\/press-releases\/nyclu-aclu-statement-scotus-concealed-carry-decision\">left-wing groups<\/a>, who argued that it would increase gun violence and prompted the passage of laws by Democratic-led states to curtail firearm access.<\/p>\n<p>\u201cA gun industry member shall not, by conduct either unlawful in itself or unreasonable under all the circumstances, knowingly or recklessly create, maintain, or contribute to a public nuisance in this State through the sale, manufacturing, distribution, importing, or marketing of a gun-related product,\u201d reads the New Jersey\u00a0<a href=\"https:\/\/casetext.com\/statute\/new-jersey-statutes\/title-2c-the-new-jersey-code-of-criminal-justice\/chapter-2c58-registration-of-manufacturers-and-wholesale-dealers-of-firearms\/section-2c58-35-gun-industry-member-engage-in-public-nuisance-prohibited-consequences-reasonable-controls\">statute<\/a>, which was challenged by the NSSF. The law also specifies that \u201c[t]he Attorney General shall not be required to demonstrate any special injury\u201d to prevail in a legal challenge on these grounds.<\/p>\n<p>The law had previously been\u00a0<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.njd.504488\/gov.uscourts.njd.504488.17.0_1.pdf\">blocked<\/a>\u00a0by U.S. District Judge Zahid Quraishi of New Jersey for purportedly violating federal law, which currently\u00a0<a href=\"https:\/\/www.congress.gov\/109\/plaws\/publ92\/PLAW-109publ92.pdf\">immunizes<\/a> gun manufacturers from lawsuits when their guns are used to commit crimes.<\/p>\n<p>The law adapts a model \u2014 creating a civil cause of action for private citizens to sue \u2014 that had been adopted by some conservative states, notably\u00a0<a href=\"https:\/\/reproductiverights.org\/case\/texas-abortion-ban-us-supreme-court\/abortion-in-texas\/#:~:text=Pre%2Dviability%20gestational%20ban%20%E2%80%93%20In,prohibited%20abortion%20at%20twenty%20weeks.\" target=\"_blank\" rel=\"noreferrer noopener\">Texas<\/a>, to enforce abortion restrictions prior to the Supreme Court\u2019s overturning of Roe v. Wade. Democratic-led states, such as California, then\u00a0<a href=\"https:\/\/www.gov.ca.gov\/2022\/04\/05\/legislation-sponsored-by-governor-newsom-to-hold-the-gun-industry-accountable-and-strengthen-protections-moves-forward\/#:~:text=SB%201327%20allows%20private%20citizens,guns%2C%20or%20ghost%20gun%20kits.\" target=\"_blank\" rel=\"noreferrer noopener\">vowed<\/a>\u00a0to use the same model to target gun manufacturers.<\/p>\n<p>\u201cDuring oral arguments, the panel appeared to have concerns with the law, as did the district court that enjoined enforcement,\u201d said Lawrence Keane, the NSSF\u2019s senior vice president and general counsel. \u201cShould New Jersey\u2019s attorney general attempt to enforce the law, we will immediately refile our complaint.\u201d<\/p>\n<p>\u201cI am thrilled,\u201d\u00a0<a href=\"https:\/\/www.nj.gov\/governor\/news\/news\/562023\/approved\/20230817c.shtml\">said<\/a>\u00a0Democratic Gov.
