{"id":96107,"date":"2023-09-18T13:23:48","date_gmt":"2023-09-18T18:23:48","guid":{"rendered":"https:\/\/milesfortis.com\/?p=96107"},"modified":"2023-09-18T13:23:48","modified_gmt":"2023-09-18T18:23:48","slug":"96107","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=96107","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/www.dailywire.com\/news\/kansas-will-no-longer-allow-residents-to-change-gender-on-birth-certificates\">Kansas Will No Longer Allow Residents To Change Gender On Birth Certificates.<\/a><\/p>\n<p><a href=\"https:\/\/www.dailywire.com\/topic\/kansas\" target=\"_blank\" rel=\"noopener\">Kansas<\/a>\u00a0will no longer allow people to change the gender on their birth certificate after Republicans passed a law enshrining the biological definition of woman into law.<\/p>\n<p>The state\u2019s health department was compelled to follow the law after Kansas Attorney General Kris Kobach sued to stop state agencies from allowing people who say they are transgender to be able to change the gender on public documents.<\/p>\n<p>After a legal back and forth, Kobach won in court, and the Kansas Department of Health and Environment\u00a0<a href=\"https:\/\/www.kdhe.ks.gov\/Faq.aspx?QID=525\" target=\"_blank\" rel=\"noopener\">said<\/a>\u00a0on Friday that it could \u201cno longer process gender identity amendments to birth certificates.\u201d<\/p>\n<p><!--more--><\/p>\n<p>The health department said that birth certificates previously given out with changed gender would not need to be updated unless the individual needed to get a new one.<\/p>\n<p>\u201cIf KDHE previously changed your birth certificate to align with your gender identity, that birth certificate is still valid; however, if a certified copy of that record is requested, then the new copy must reflect the sex assigned at birth,\u201d the department said. Kobach said that he was \u201cpleased\u201d with the decision and that it was necessary to comply with Kansas law.<\/p>\n<p>\u201cThe intent of\u00a0[the Kansas legislature] was clear when lawmakers passed the Women\u2019s Bill of Rights. KS birth certificates are state records that must reflect scientific fact as recorded by the doctor at the time of birth,\u201d Kobach\u00a0<a href=\"https:\/\/twitter.com\/KrisKobach1787\/status\/1702802313667063886\" target=\"_blank\" rel=\"noopener\">posted<\/a>\u00a0on X.<\/p>\n<p>Kobach was referring to a state law passed earlier this year \u2014 called the Women\u2019s Bill of Rights \u2014 that\u00a0<a href=\"https:\/\/www.dailywire.com\/news\/kansas-senate-passes-first-bill-defining-woman-as-a-biological-female\" target=\"_blank\" rel=\"noopener\">defines<\/a> men and women on the basis of their \u201cbiological reproductive system.\u201d<\/p>\n<p>According to the\u00a0<a href=\"https:\/\/kslegislature.org\/li\/b2023_24\/measures\/documents\/summary_sb_180_2023\" target=\"_blank\" rel=\"noopener\">law<\/a>, a \u201cfemale\u201d is \u201can individual whose biological reproductive system is developed to produce ova\u201d and a \u201cmother\u201d is\u201d a parent of the female sex.\u201d The law also stipulates that \u201cwoman\u201d and \u201cgirl\u201d refer to biological females.<\/p>\n<p>The law says that state entities that collect \u201cvital statistics for the purpose of complying with anti-discrimination laws or for the purpose of gathering accurate public health, crime, economic or other data shall identify each person who is part of the collected data set as either male or female at birth.\u201d<\/p>\n<p>Democrat Governor Laura Kelly\u00a0<a href=\"https:\/\/www.kslegislature.org\/li\/b2023_24\/measures\/documents\/sb180_enrolled.pdf\" target=\"_blank\" rel=\"noopener\">vetoed<\/a>\u00a0the bill, saying it \u201cstripp[ed] away rights\u201d and would \u201churt our ability to continue \u2026 landing new business deals.\u201d The Republican-controlled legislature\u00a0<a href=\"https:\/\/www.metroweekly.com\/2023\/05\/kansas-republicans-override-veto-of-transgender-bathroom-ban\/\" target=\"_blank\" rel=\"noopener\">overrode<\/a>\u00a0her veto, with the law going into effect July 1.<\/p>\n<p>Kelly\u00a0<a href=\"https:\/\/www.nytimes.com\/2023\/09\/15\/us\/kansas-transgender-birth-certificates.html#:~:text=Kansas%20will%20no%20longer%20change,person%27s%20sex%20assigned%20at%20birth.\" target=\"_blank\" rel=\"noopener\">said<\/a>\u00a0in\u00a0 a statement on Friday that she disagreed with the policy but would allow the law to be enforced.<\/p>\n<p>\u201cAs I\u2019ve said before, the state should not discriminate or encroach into Kansans\u2019 personal lives,\u201d Kelly said in a statement. \u201cHowever, I am committed to following the law.
