Lawsuits Already Filed Over California\u2019s Newest Gun Control Laws<\/a><br \/>\n<em>GOA, GOF join Gun Owners of California in suit challenging California\u2019s brand new anti-concealed carry law<\/em><\/p>\n<div>\n<p><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202320240SB2\"><strong>Senate Bill 2<\/strong><\/a>\u00a0by Senator Anthony Portantino\u2019s (D\u2013Burbank), which is California\u2019sresponse bill to\u00a0<em>New York Rifle and Pistol Association v. Bruen<\/em>, was signed into law Tuesday. SB 2 enacts numerous \u201csensitive locations\u201d where guns are banned, and changes requirements to obtain a concealed carry license. SB 2 was also sponsored by Gov. Gavin Newsom and Attorney General Rob Bonta, and simply put illegally imposes restrictions on those seeking a California Concealed Carry Weapons (CCW) permit.<\/p>\n<p>Notably, Newsom, Bonta and Portantino know they are imposing restrictions to those applying for CCWs, when virtually no crimes are committed by CCW holders, who are required to pass background checks by County Sheriffs, and take gun safety courses.<\/p>\n<p>Remarkably, CCW permit holders don\u2019t commit mass shootings, they stop them. We\u2019ve never had a comment or even a reaction from Gov. Newsom, AG Bonta or Sen. Portantino on this fact. This unconstitutional legislation was passed in response to the Bruen decision (which ended the state\u2019s draconian \u201cmay-issue\u201d policy), and among other provisions would:<\/p>\n<\/div>\n<div>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul role=\"list\">\n<li role=\"listitem\" aria-setsize=\"-1\">Enact highly restrictive \u201csensitive locations\u201d where concealed carrying would be prohibited, including all private property unless expressly permitted by the owner;<\/li>\n<li role=\"listitem\" aria-setsize=\"-1\">Require 16 hours of training;<\/li>\n<li role=\"listitem\" aria-setsize=\"-1\">And significantly increase the costs associated with securing a permit.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/div>\n<div>\n<p>This suit specifically goes after the \u201csensitive locations\u201d provision of the law.<\/p>\n<\/div>\n<p>So that is strike one.<\/p>\n<p>This is strike two.<\/p>\n<\/div>\n<p><!--more--><\/p>\n<div>\n<p>Tuesday, Gov. Gavin Newsom also signed into law\u00a0<a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202320240AB28\"><strong>AB 28<\/strong><\/a>, \u201cthe\u00a0<i>Gun Violence Prevention and School Safety Act<\/i>,\u201d to tax the gun industry claiming to create a permanent funding source \u201cfor school safety and gun violence prevention programs\u201d in California. Voter beware when politicians claim \u201cschool safety\u201d \u2013 it\u2019s usually there opposite.<\/p>\n<p>According to Gov. Newsom, taxing legal gun owners even more for their legal purchases of a gun will put an end to crime and violence. Newsom and bill author Assemblyman Jesse Gabriel (D-Encino), are silent on the\u00a0<a href=\"https:\/\/californiaglobe.com\/fr\/target-announces-three-locations-in-sf-bay-area-are-closing-because-of-rampant-crime\/\">staggering crime<\/a>\u00a0spiking in the state, and instead look to imposing unconstitutional gun control measures on legal gun owners.<\/p>\n<p>AB 28 will impose an 11 percent excise tax on the sale of guns and ammunition by gun manufacturers and dealers and is expected to generate $160 million annually to fund school safety and violence prevention programs, including initiatives to prevent mass shootings, bolster firearm investigations, and remove guns from domestic abusers.\u201d<\/p>\n<p>AB 28 will also end world hunger.<\/p>\n<p>Imposing excise taxes on enumerated rights is unconstitutional.<\/p>\n<p>Justice Clarence Thomas\u2019 clearly laid out in his written decision in the\u00a0<em>New York Rifle and Pistol Association v. Bruen\u00a0<\/em>case in what can and cannot be done, noting that there should never be a test to determine if someone is permitted to carry a gun, based on the 2nd Amendment.<\/p>\n<p>And in the face of that decision, California lawmakers have shown they do not care about the Constitution, except when it protects their activities.<\/p>\n<p>Justice ClarenceThomas wrote the majority opinion in the 6-3 ruling: \u201cThe constitutional right to bear arms in public for self-defense is not \u2018a second-class right, subject to an entirely different body of rules than the other Bill of Rights guarantees.\u2019 The exercise of other constitutional rights does not require individuals to demonstrate to government officers some special need. The Second Amendment right to carry arms in public for self-defense is no different. New York\u2019s proper-cause requirement violates the Fourteenth Amendment by preventing law-abiding citizens with ordinary self-defense needs from exercising their right to keep and bear arms in public.\u201d<\/p>\n<p>\u201cThis \u2018special need\u2019 standard is demanding,\u201d Thomas wrote. \u201cFor example, living or working in an area \u2018noted for criminal activity\u2019 does not suffice.\u201d In 43 other states, Thomas noted, authorities are required to issue licenses to applicants who meet certain requirements, and officials do not have discretion to say no due to what they believe is an insufficient need.\u201d<\/p>\n<p>Despite being rebuked by the highest court in the country over gun control attempts last year, California Democrats continue to tell the people through unconstitutional legislation that you can\u2019t defend yourself with a firearm\u2026 or at least they will limit who can carry, and where you can carry.<\/p>\n<\/div>\n<p><!--more--><\/p>\n<div>\n<p>Gun Owners of America and the Gun Owners Foundation said several other anti-gun states have enacted similar unconstitutional legislation in response to the Bruen decision, and GOA and GOF are a part of litigation in several of these cases.<\/p>\n<\/div>\n<div>\n<p><strong>Erich Pratt, GOA\u2019s Senior Vice President, issued the following statement:\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/strong><\/p>\n<\/div>\n<div>\n<p><em>\u201cThis is just the latest assault on our rights in California. Just as concerning, Governor Gavin Newsom has already made his anti-gun intentions quite clear: he wants to effectively repeal the Second Amendment. Sadly, his acknowledgment that doing so would be the only way to enact more gun control did not dissuade him from violating his oath when he signed this law into effect, but we are fully prepared to fight back.\u201d\u00a0<\/em><\/p>\n<\/div>\n<div>\n<p><strong>Sam Paredes, on behalf of the board for GOF and in his role as the Executive Director of Gun Owners of California, added:\u00a0\u00a0\u00a0<\/strong><\/p>\n<\/div>\n<div>\n<p><em>\u201cPro-gun groups in California have had success when pushing back on legislation like this \u2013 just look at our victory last week against the state\u2019s magazine ban. And just like in that case, we are confident SB 2 will be overturned. I\u2019ve been warning governors and legislatures across the country since the Bruen decision that these \u201cresponse bills\u201d will not stand, but unfortunately, many have still been pushed through. That won\u2019t stop us however \u2013 states should fall in line, or we will make them.\u201d\u00a0\u00a0<\/em><\/p>\n<\/div>\n<p>In June,\u00a0<a href=\"https:\/\/californiaglobe.com\/fr\/firearms-policy-coalition-f-you-gov-newsom\/\">Gov. Gavin Newsom,<\/a>\u00a0who pretends he isn\u2019t running for President,\u00a0<a href=\"https:\/\/californiaglobe.com\/fr\/gov-newsom-proposes-constitutional-amendment-to-restrict-national-gun-rights\/\">proposed a 28th Constitutional Amendment<\/a>\u00a0to restrict national gun rights, and had the chutzpah to claim it will \u201cleave the 2nd Amendment unchanged and respecting America\u2019s gun-owning tradition.\u201d Don\u2019t count on it<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Whamm, Zwap, Bam!
