{"id":96856,"date":"2023-10-16T14:02:46","date_gmt":"2023-10-16T19:02:46","guid":{"rendered":"https:\/\/milesfortis.com\/?p=96856"},"modified":"2023-10-16T14:02:46","modified_gmt":"2023-10-16T19:02:46","slug":"96856","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=96856","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/thefederalist.com\/2023\/10\/16\/judge-bars-trump-from-campaigning-against-his-top-political-opponent\/\" target=\"_blank\" rel=\"noopener\">Judge Bars Trump From Campaigning Against His Top Political Opponent<\/a><\/p>\n<p>A U.S. District Court judge has barred former President Donald Trump from campaigning against his top political opponent: the federal government.<\/p>\n<p>On Monday, Judge Tanya Chutkan issued a gag order to prohibit the Republican frontrunner from speaking out on the case just more than a year out from the next election. The order bars Trump from publicly defending himself against attacks from potential witnesses, court personnel, or federal prosecutors in the case, including Special Counsel Jack Smith.<\/p>\n<p>\u201cThis is not about whether I like the language Mr. Trump uses,\u201d Judge Chutkan reportedly\u00a0<a href=\"https:\/\/www.wsj.com\/us-news\/law\/judge-issues-limited-gag-order-on-trump-in-federal-election-interference-case-f7620ff3\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>. \u201cThis is about language that presents a danger to the administration of justice.\u201d<\/p>\n<p>The order itself, however, presents a danger to American democracy. Democrats are already trying to prevent Americans from being given the chance to vote on the former president. Now, far-left activists are wielding the judiciary to prevent Trump from leading an effective campaign. With a more than 45-point\u00a0<a href=\"https:\/\/www.realclearpolitics.com\/epolls\/2024\/president\/us\/2024_republican_presidential_nomination-7548.html\" target=\"_blank\" rel=\"noreferrer noopener\">lead<\/a>\u00a0in the Republican primary, Trump isn\u2019t running against the other candidates attempting to challenge him. He\u2019s running against the Department of Justice, and the Department of Justice under President Joe Biden is running against him with\u00a0<a href=\"https:\/\/www.nytimes.com\/interactive\/2023\/us\/trump-investigations-charges-indictments.html\" target=\"_blank\" rel=\"noreferrer noopener\">44\u00a0<\/a>federal indictments to thwart the GOP frontrunner\u2019s triumphant return.<\/p>\n<p>The special counsel prosecuting Trump over protestors\u2019 2021 attack on the Capitol\u00a0<a href=\"https:\/\/thefederalist.com\/2023\/09\/19\/special-counsel-jack-smiths-gag-order-designed-to-destroy-trumps-first-amendment-right-to-criticize-biden-on-campaign-trail\/\" target=\"_blank\" rel=\"noreferrer noopener\">requested<\/a>\u00a0the gag order in September, alleging the former president\u2019s statements over the case sought to \u201cundermine the integrity of these proceedings and prejudice the jury pool.\u201d Yet the proceedings were undermined from the start with the selection of Judge Chutkan to preside over the politically charged case in the nation\u2019s capital. Just more than a week after Smith requested the gag order, Chutkan\u00a0<a href=\"https:\/\/thefederalist.com\/2023\/09\/28\/of-course-judge-chutkan-wont-recuse-herself-from-trumps-j6-case-she-has-a-narrative-to-prove\/\" target=\"_blank\" rel=\"noreferrer noopener\">refused<\/a>\u00a0a motion from Trump\u2019s legal team that she recuse herself from the trial.<\/p>\n<p>There has never been any doubt on how Chutkan might rule on consequential decisions since the Jan. 6 indictments were first handed down on Aug. 1. An activist judge with an obvious animus against the former president and his supporters, federal prosecutors could not have been given a more friendly judge in a district more friendly to the government\u2019s case. Beyond the fact residents in Washington D.C.\u00a0<a href=\"https:\/\/www.nytimes.com\/interactive\/2020\/11\/03\/us\/elections\/results-district-of-columbia-president.html\" target=\"_blank\" rel=\"noreferrer noopener\">voted<\/a>\u00a0for Biden over Trump in 2020 by a whopping 92 to 5 percent, an Emerson College\u00a0<a href=\"https:\/\/thefederalist.com\/2023\/09\/06\/new-poll-shows-trump-wont-get-a-fair-jury-trial-from-d-c-residents-whove-already-decided-hes-guilty\/\" target=\"_blank\" rel=\"noreferrer noopener\">survey<\/a>\u00a0found a majority, 64 percent, had already made up their minds to vote in favor of convicting Trump if they were selected for his jury. Only 8 percent said they would find Trump innocent, and another 28 percent were unsure. Chutkan herself is likely among those who would vote in favor of convicting based on recent rulings and statements.<\/p>\n<div id=\"stickypbModal2395\">\n<div><a href=\"https:\/\/apnews.com\/article\/trump-indictment-judge-tanya-chutkan-capitol-riot-9ba5c18d315697d759521425ea203012\" target=\"_blank\" rel=\"noreferrer noopener\">According<\/a>\u00a0to the Associated Press in August, the Obama-appointed judge built a reputation as \u201ca tough punisher of Capitol rioters.\u201d Chutkan presided over more than three dozen cases of those charged with crimes related to the Capitol riot.<\/div>\n<\/div>\n<p>\u201cOther judges typically have handed down sentences that are more lenient than those requested by prosecutors,\u201d reported the AP. \u201cChutkan, however, has matched or exceeded prosecutors\u2019 recommendations in 19 of her 38 sentences. In four of those cases, prosecutors weren\u2019t seeking any jail time at all.\u201d<\/p>\n<p>Chutkan has also condemned comparisons of the Jan. 6 Capitol riot to the deadly riots for so-called \u201csocial justice\u201d of 2020. The fiery riots, she\u00a0<a href=\"https:\/\/apnews.com\/article\/trump-indictment-judge-tanya-chutkan-capitol-riot-9ba5c18d315697d759521425ea203012\" target=\"_blank\" rel=\"noreferrer noopener\">claimed<\/a>\u00a0in one hearing, were actually \u201cthe actions of people protesting, mostly peacefully, for civil rights.\u201d The Capitol riot, on the other hand, was an attempt to\u00a0\u201cviolently overthrow the government.\u201d Never mind the\u00a0<a href=\"https:\/\/v2-9mdnszte.thefederalist.com\/2020\/09\/16\/george-floyd-riot-damage-could-cost-insurance-companies-upwards-of-2-billion\/\" target=\"_blank\" rel=\"noreferrer noopener\">$2 billion<\/a>\u00a0worth of damage, making the outbreak of leftist violence one of the most destructive in American history, and \u201cprotestors\u201d\u00a0<a href=\"https:\/\/thefederalist.com\/2020\/08\/21\/portland-closes-federal-courthouse-over-threats-of-domestic-terrorism\/\" target=\"_blank\" rel=\"noreferrer noopener\">targeting<\/a>\u00a0of federal buildings. The carnage from the summer of rage cost\u00a0<a href=\"https:\/\/thefederalist.com\/2021\/02\/26\/estimates-george-floyd-riots-to-cost-66-times-more-than-capitol-damage\/#:~:text=Estimates%3A%20George%20Floyd%20Riots%20To%20Cost%2066%20Times%20More%20Than%20Capitol%20Damage&amp;text=The%20Capitol%20architect%20told%20lawmakers,cost%20an%20estimated%20%242%20billion.\" target=\"_blank\" rel=\"noreferrer noopener\">66 times<\/a> more than the estimated damage done to the Capitol in the hours-long riot.<\/p>\n<p>Trump\u2019s Republican rivals\u00a0<a href=\"https:\/\/www.washingtonexaminer.com\/news\/campaigns\/desantis-campaign-slams-trump-pac-legal-spending\" target=\"_blank\" rel=\"noreferrer noopener\">attacked<\/a>\u00a0him for shelling out a disproportionate amount of campaign funds for his own legal defense. Those attacks, however, fail to grapple with the reality that for Trump, his serious opponents aren\u2019t the other Republicans in the race.
