Section 702 is a controversial government surveillance law, and the proposed move\u00a0<a href=\"https:\/\/www.breitbart.com\/politics\/2023\/11\/29\/54-bipartisan-lawmakers-urge-speaker-johnson-not-to-slip-deep-state-surveillance-authorization-defense-bill\/\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\">received<\/a>\u00a0strong backlash from 54 bipartisan House lawmakers and House Judiciary Committee Chairman Jim\u00a0<a href=\"https:\/\/www.breitbart.com\/politics\/2023\/11\/29\/rep-jim-jordan-opposes-any-deep-state-surveillance-in-defense-bill\/\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\">Jordan<\/a>\u00a0(R-OH).<\/p>\n<p>\u201cKeeping FISA out of the NDAA is a victory for the American people who demand the end of warrantless government surveillance. I applaud Speaker Johnson\u2019s decision to not cave to the Biden admin, Christopher Wray, and the entire intel community,\u201d Rep. Warren Davidson (R-OH) told Breitbart News in a written statement.<\/p>\n<p data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">At one point, Johnson\u2019s office refused to confirm to Breitbart News Rep. Matt Gaetz\u2019s (R-FL) claim that there would be no reauthorization, temporary or otherwise, of Section 702.<\/p>\n<p data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">Johnson\u00a0<a href=\"https:\/\/www.politico.com\/live-updates\/2023\/12\/05\/congress\/house-gop-702-fisa-00130097?nname=playbook-pm&amp;nid=0000015a-dd3e-d536-a37b-dd7fd8af0000&amp;nrid=0000014f-bdae-dcaf-ab5f-fdeff4d00001&amp;nlid=964328\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\">said<\/a>\u00a0that they would allow for the different Section 702 fixes to be considered on the House floor:<\/p>\n<blockquote data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">\n<p data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span style=\"font-size: 12pt; color: #000000;\"><strong>During a closed-door conference meeting on Tuesday, Johnson said that he could bring Jordan\u2019s and Turner\u2019s two competing bills up for a vote in a rare procedural gambit known as \u201cKing of the Hill\u201d if there isn\u2019t a consensus over Section 702, according to two Republicans in the room. <\/strong><\/span><\/p>\n<p data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span style=\"font-size: 12pt; color: #000000;\"><strong>Under that gambit, leadership can bring competing proposals to the floor as amendments, and whichever proposal is the last one that comes up for a vote and still gets a majority is the one that gets adopted. It allows leadership to try to influence the outcome by putting its preferred proposal last.<\/strong><\/span><\/p>\n<\/blockquote>\n<p data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">As recently as Tuesday, Sen. Ron Wyden (D-OR), who cosponsored the Government Surveillance Reform Act with Sen. Mike Lee (R-UT) to rein in Section 702, opposed an extension in the NDAA.<\/p>\n<p data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">\u201cWe\u2019re going the distance\u00a0with reform. Business as usual is not going to be acceptable. When I started, it was pretty lonely. You could have meetings about 702 reform operations in a couple of phone booths. And I\u2019m looking around now and I\u2019m seeing a lot of allies,\u201d Wyden\u00a0<a href=\"https:\/\/punchbowl.news\/archive\/12523-punchbowl-news-am-2\/\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\">said<\/a>, noting that he does not see how a clean authorization could have been possible with the strong bipartisan opposition to such a move.<\/p>\n<p data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">As Johnson and other congressional leaders no longer wish to include Section 702 in the NDAA debate, the Judiciary Committee will now consider the merits of their proposal to rein in the controversial surveillance law.<\/p>\n<p data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><!--more--><\/p>\n<p data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">The Protect Liberty and End Warrantless Surveillance Act (PLEWSA) \u00a0would\u00a0<a href=\"https:\/\/www.breitbart.com\/politics\/2023\/12\/04\/jim-jordan-zeroes-deep-state-surveillance-solution\/\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\">require\u00a0<\/a>a warrant for any Americans\u2019 information sought under Section 702. The program does not currently require a warrant for such a search.<\/p>\n<p data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">The legislation would also prohibit law enforcement and intelligence agencies from purchasing Americans\u2019 private data through data brokers, a practice which has been known as the \u201cdata broker loophole.\u201d Biggs and other lawmakers have decried this practice, believing it to be a run around the Fourth Amendment.<\/p>\n<p data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">The Judiciary bill would also limit how many FBI agents can search the Section 702 database and would set up penalties for violations under FISA.<\/p>\n<p data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">Reps. Andy Biggs (R-AZ), Jim Jordan (R-OH), Jerry Nadler (D-NY), Pramila Jayapal (D-WA), Warren Davidson (R-OH), Sara Jacobs (D-CA), and Russell Fry (R-SC) sponsored the legislation.<\/p>\n<p data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">Biggs\u00a0<a href=\"https:\/\/biggs.house.gov\/media\/press-releases\/congressman-biggs-introduces-major-legislation-end-warrantless-surveillance\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\">said<\/a>\u00a0in a written statement:<\/p>\n<blockquote data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">\n<p data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span style=\"font-size: 12pt; color: #000000;\"><strong>America\u2019s\u00a0intelligence community continues to conduct a warrantless, mass surveillance campaign on innocent citizens.\u00a0In 2021 alone, the FBI misused FISA 278,000 times to spy on American citizens \u2013 including a U.S. congressman and political donors.\u00a0Our civil liberties are at stake. Without serious reforms to FISA 702, our Fourth Amendment rights will be all but gone.\u00a0<\/strong><\/span><\/p>\n<p data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span style=\"font-size: 12pt; color: #000000;\"><strong>My legislation addresses numerous loopholes in federal law to end this unconstitutional practice and to ensure rogue agents are held accountable.\u00a0I am grateful for the bipartisan, bicameral effort to overhaul the FISA 702 spying authority. I\u00a0call on my colleagues to pass this legislation into law.<\/strong><\/span><\/p>\n<\/blockquote>\n<p data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span style=\"font-size: 12pt; color: #000000;\">Jordan also addressed the subject in a written statement:<\/span><\/p>\n<blockquote data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">\n<p data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span style=\"font-size: 12pt; color: #000000;\"><strong>Substantial reforms to FISA are long overdue, and we commend Chairman Biggs for his steadfast commitment to reining in unchecked surveillance of Americans. The House has never been in a better position to pass sweeping and much-needed reforms, and we look forward to the Protect Liberty and End Warrantless Surveillance Act\u2019s consideration in the Judiciary Committee.<\/strong><\/span><\/p>\n<\/blockquote>\n<p data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">Privacy-oriented groups such as Americans for Prosperity, FreedomWorks, Demand Progress, and others back the legislation.<\/p>\n<p data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">\u201cThe Protect Liberty and End Warrantless Surveillance Act is a\u00a0 significant step forward to restoring the right to privacy,\u201d Davidson wrote. \u201cThis legislation prohibits the government from purchasing Americans\u2019 data from big tech companies without a search warrant and adds needed warrant requirements to Section 702 of FISA.
