Biden Administration Urges Supreme Court To Overturn Injunction on Federal Agencies Influencing Tech Censorship<\/a>
\nBiden wants the Supreme Court to support its censorship efforts<\/em>.<\/p>\n

The US Court of Appeals for the Fifth Circuit recently affirmed an\u00a0injunction<\/a>\u00a0against federal agencies to stop the current White House from colluding with Big Tech\u2019s social media.<\/p>\n

And now, the Biden Administration is\u00a0going to the US Supreme Court<\/a>\u00a0in a last-ditch attempt to reverse this decision.<\/p>\n

The big picture effect \u2013 or at least, the intended meaning \u2013 of the Fifth Circuit ruling was to stop the government from working with Big Tech in censoring online content.<\/p>\n

There\u2019s little surprise that this doesn\u2019t sit well with that government, which now hopes that the federal appellate court\u2019s decision can be overturned.<\/p>\n

The White House says the ruling is banning its \u201cgood\u201d work done alongside social media to combat \u201cmisinformation\u201d; instead of admitting its actions to amount to collusion with Big Tech \u2013 which has been amply documented now, not least by the Twitter Files \u2013 the government insists its actions are serving the public, and its \u201cability\u201d to discuss relevant issues.<\/p>\n

We obtained a copy of the petition for you\u00a0here<\/a>.<\/strong><\/p>\n

US Surgeon General Vivek Murthy<\/a>\u00a0is back again here \u2013 to say that what those now in power in the US (a message amplified by legacy media) did ahead of the 2020 presidential election, as well as subsequently regarding the pandemic \u201cmisinformation\u201d \u2013 which is now fairly widely accepted to be censorship (\u201cmoderation\u201d) \u2013 is what Murthy still calls, justified.<\/p>\n

By what, though? Because the appellate court\u2019s ruling looked into the government\u2019s \u201cpersuasive actions\u201d (and no, you\u2019re not reading a line from a gangster movie script, where \u201ccoercion\u201d is spelled as, \u201curging\u201d, etc.).<\/p>\n

In any case, the appellate court found these actions were in fact coercive and unconstitutional.<\/p>\n

Well, Murthy believes the court got it all wrong. The Fifth Circuit is accused of \u201cimproperly applying new and unprecedented\u201d remedies. (No \u2013 he was not talking about the Covid vaccine(s). The reference was to the court\u2019s allegedly flawed \u201clegal theories\u201d).<\/p>\n

Murthy and other administration representatives are telling the Supreme Court that what the Fifth Circuit found to be unconstitutional, was actually \u201clawful persuasive governmental actions.\u201d<\/p>\n

The \u201cgrand\u201d argument here is that, historically, US governments have been using free speech as a vehicle to promote their policies. And so \u2013 why would this case of \u201curging\u201d Big Tech be any different?<\/p>\n
