It\u2019s one of her guilty pleasures, even though she knows from the get-go how the story is going to play out. Girl meets guy under improbable circumstances, there\u2019s immediate friction with an undercurrent of attraction, they get together, there\u2019s a huge blowup, and yet they manage to reconcile and live happily ever after. The characters and the locations may change, but the story is basically always the same.<\/p>\n<p>The Ninth Circuit Court of Appeals is like the Hallmark Channel of the judicial system, at least when it comes to gun control fans. No matter what law is being challenged or how egregiously it violates our Second Amendment rights, lawsuits in the Ninth Circuit seem to follow the same script: gun owners sue, a judge agrees that the law is likely to be unconstitutional and grants an injunction, only to have it stayed and eventually overturned. Sometimes we get a plot twist and a three-judge panel will uphold the injunction, but inevitably\u00a0<em>that\u00a0<\/em>decision is overruled by an en banc review. No matter how improbable or untenable the decision may be, anti-gunners are assured of a happy ending in the Ninth.<\/p>\n<p>Not once in the fifteen years since the\u00a0<em>Heller\u00a0<\/em>decision was handed down has the Ninth Circuit ultimately concluded that a gun control law goes too far and abridges a fundamental right, and though it\u2019s still fairly early the appellate court looks to be keeping that streak alive by allowing California\u2019s new \u201cgun-free zones\u201d to take effect today after a rare Saturday ruling to\u00a0<a href=\"https:\/\/www.msn.com\/en-us\/news\/us\/federal-appeals-court-temporarily-allows-california-to-ban-guns-in-public-places\/ar-AA1mgtS1\" target=\"_blank\" rel=\"noopener\">grant an administrative stay<\/a> of Judge Cormac Carney\u2019s injunction halting enforcement of the new bans in supposedly sensitive places\u2026 including virtually every publicly accessible business that doesn\u2019t specifically post signage welcoming concealed carry holders.<\/p>\n<p><!--more--><\/p>\n<blockquote><p><strong><span style=\"font-size: 12pt;\">State Attorney General Rob Bonta had sought an administrative stay of the lower court\u2019s ruling, <a href=\"https:\/\/oag.ca.gov\/news\/press-releases\/attorney-general-bonta-appeal-decision-blocking-enforcement-sb-2%E2%80%99s-prohibition\" target=\"_blank\" rel=\"noopener\" data-t=\"{&quot;n&quot;:&quot;destination&quot;,&quot;t&quot;:13,&quot;b&quot;:1,&quot;c.t&quot;:7}\">arguing that it would allow dangerous weapons<\/a><\/span><span style=\"font-size: 12pt;\">in places where children and families congregate. By granting Bonta\u2019s motion, the 9th Circuit judges have put the district court\u2019s injunction on pause while a separate panel of judges weighs an appeal by the state.<\/span><\/strong><\/p>\n<p><strong><span style=\"font-size: 12pt;\">Gov. Gavin Newsom celebrated the <\/span><span style=\"font-size: 12pt;\">ruling<a href=\"https:\/\/twitter.com\/CAgovernor\/status\/1741241243131379911\" target=\"_blank\" rel=\"noopener\"> in a statement<\/a>\u00a0posted to social media Saturday night.<\/span><\/strong><\/p>\n<p><span style=\"font-size: 12pt;\"><strong>\u201cCalifornians overwhelmingly support efforts to ensure that places like hospitals, libraries and children\u2019s playgrounds remain safe and free from guns,\u201d Newsom said.<\/strong><\/span><\/p><\/blockquote>\n<p>Despite Newsom\u2019s contention that the stay only keeps the status quo in place, the fact is that the vast majority of these \u201cgun-free zones\u201d aren\u2019t longstanding, and weren\u2019t even in place until now. They\u2019re artifacts of SB 2, and before today it was perfectly legal for concealed carry holders to carry for self-defense and the defense of others in these locations unless the private property owner specifically posted signage to the contrary. And as the Firearms Policy Coalition pointed out in response to Newsom, it doesn\u2019t matter how many Californians support these restrictions, because they trample on a fundamental civil right.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">No level of support justifies violating the rights of peaceable people, and the death of these public carry bans is inevitable. <\/p>\n<p>We look forward to harvesting your tears with great joy in our hearts. <a href=\"https:\/\/t.co\/fisr8Mv5Cv\">https:\/\/t.co\/fisr8Mv5Cv<\/a><\/p>\n<p>&mdash; Firearms Policy Coalition (@gunpolicy) <a href=\"https:\/\/twitter.com\/gunpolicy\/status\/1741263313458082237?ref_src=twsrc%5Etfw\">December 31, 2023<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>The administrative stay doesn\u2019t guarantee that a Ninth Circuit panel will block Carney\u2019s injunction, but it\u2019s hard to ignore the feeling that we\u2019ve seen this story many times before and we know how this is gonna play out\u2026 at least until the Supreme Court gets to write the final scene.
