J.B. Pritzker it looks like there was no last-minute flood of registrations. <strong>According to the latest figures from the Illinois State Police, about 15,000 FOID holders had registered one or more firearm, \u201clarge capacity\u201d magazine, or other device named in the Protect Illinois Communities Act as of late last week; about double the number that the ISP had previously reported, but still fewer than one percent of the nearly two million Firearm Owner ID card holders in the state.<\/strong><\/span><\/p>\n<div class=\"thm-piano-mop-premium pf-candidate\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Not everyone who possesses a valid FOID card ones one or more of the guns banned under the Protect Illinois Communities Act, but my guess is that the vast majority of them own either a firearm covered under PICA or a \u201clarge capacity\u201d magazine that\u2019s supposed to be registered with the state police. Compliance with the registration looks to be almost non-existent, which raises the question of how, exactly, the new ban will be enforced\u00a0<\/span><a href=\"https:\/\/www.cbsnews.com\/chicago\/news\/illinois-assault-weapons-deadline\/\" target=\"_blank\" rel=\"noopener\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">going forward<\/span><\/a><span class=\"text-node\">.<\/span><\/p>\n<blockquote data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><strong><span class=\"text-node\" style=\"font-size: 12pt;\">In November, state police said it is up to prosecutors in the state\u2019s 102 counties to enforce the law, but it\u2019s unclear what penalties would be in store for those who fail to register their weapons. Penalties can vary for illegal weapons. Carrying or possessing unauthorized assault weapons could result in a misdemeanor, with one year in jail or a fine of up to $2,500. Manufacturing, selling, or purchasing an unauthorized weapon could constitute a felony and result in up to 10 years in prison and a fine of up to $25,000.<\/span><\/strong><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><strong><span class=\"text-node\" style=\"font-size: 12pt;\">Kane County Sheriff Ron Hain explained that his deputies won\u2019t be going door to door to find residents who may have a FOID card and \u201casking to see all of their weapons.\u201d He said the law works more during high-profile investigations.<\/span><\/strong><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><strong><span class=\"text-node\" style=\"font-size: 12pt;\">\u201cHowever, if we are investigating a criminal organization and we do come across firearms that are in violation of the assault weapons ban, we will certainly use this new law to enhance criminal charges against them,\u201d Hain said.<\/span><\/strong><\/p>\n<\/blockquote>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">While some sheriffs like Hain say they\u2019ll enforce the law if there are more serious charges attached, other sheriffs and even some state\u2019s attorneys have indicated they have no plans on enforcing the law at all, much to the chagrin of gun control advocates, anti-gun politicians, and their\u00a0<\/span><a href=\"https:\/\/www.courthousenews.com\/illinois-has-banned-assault-weapon-ownership-but-local-sheriffs-say-they-wont-enforce-it-now-what\/\" target=\"_blank\" rel=\"noopener\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">allies in the media<\/span><\/a><span class=\"text-node\">.<\/span><\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<p data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><!--more--><\/p>\n<div class=\"container d-flex flex-column pf-app-wrapper justify-content-start\">\n<div class=\"d-flex flex-row pf-app-row flex-auto\">\n<div class=\"pf-app-inner d-flex flex-column pf-app-shadow\">\n<div id=\"pf-body\" class=\"browser pf-content-wrapper px-2 px-sm-4 px-md-5 pt-2 pt-sm-3\">\n<div id=\"printfriendly\" class=\"print-only\">\n<div>\n<div id=\"pf-print-area\" class=\"clearfix js-print-area content-unmask direction-ltr\">\n<div id=\"pf-content\" class=\"js-pf-content pf-12\">\n<div id=\"\" class=\"\">\n<div class=\"thm-piano-mop-premium pf-candidate\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">\n<blockquote data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span style=\"font-size: 12pt;\"><strong><span class=\"text-node\">According to University of Illinois \u2013 Chicago political science professor Alexandra Filindra, who has extensively researched the confluence of guns, policing and politics, the divide between liberal Chicago legislators passing stricter gun laws and conservative downstate sheriffs refusing to enforce them is the latest iteration of a conflict going back to the founding of the country and the socioeconomic premises it was founded upon.<\/span><\/strong><\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span style=\"font-size: 12pt;\"><strong><span class=\"text-node\">At the center of the debate, she said, is the question of who gets to be a \u201cgood American\u201d and who gets labeled as those good Americans\u2019 enemies.<\/span><\/strong><\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span style=\"font-size: 12pt;\"><strong><span class=\"text-node\">Historically, she explained, the \u201cgood Americans\u201d have been white, Christian, property-owning men. And being a good American is more than just belonging to an elite social club. By virtue of being white men who own property and profess Christian faith, Filindra said, one\u2019s ability to govern themselves and others is made self-evident.<\/span><\/strong><\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span style=\"font-size: 12pt;\"><strong><span class=\"text-node\">\u201cThis is consistent with ideals of Jeffersonian Democracy, which held that the \u2018Good Americans\u2019 were the freeholders,\u201d she said. \u201cIt was the property owners who can be trusted with the state.\u201d<\/span><\/strong><\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span style=\"font-size: 12pt;\"><strong><span class=\"text-node\">Part of being trusted with the state or property, she explained, is the expectation that you will defend it \u2014 by force of arms if need be \u2014 from the good Americans\u2019 enemies. Not just foreign soldiers, but indigenous peoples, Black slaves, agitating laborers and others.<\/span><\/strong><\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span style=\"font-size: 12pt;\"><strong><span class=\"text-node\">This call to arms to defend whiteness, home and property from the threat posed by not-good Americans has echoed down the centuries, Filindra said, even being enshrined in deceased, conservative Supreme Court Justice Antonin Scalia\u2019s majority opinion in the 2008 landmark gun rights case\u00a0<\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/554\/570\/\" target=\"_blank\" rel=\"noopener\" data-type=\"link\" data-id=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/554\/570\/\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">District of Columbia v. Heller<\/span><\/a><\/em><span class=\"text-node\">.<\/span><\/strong><\/span><\/p>\n<\/blockquote>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Give me a break. The right to keep and bear arms is a right of the people, not a right of conservatives, white dudes, or property owners. And I would love to see the part of the\u00a0<\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Heller\u00a0<\/span><\/em><span class=\"text-node\">decision that Filindra believes enshrines \u201cdefending whiteness\u201d with a firearm. The truth is that gun ownership has become much more diverse over the past couple of decades, with the largest growth in recent years seen in minority communities and even among Democrats.<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node pf-delete\">The anti-gunners are already attempting to twist history to portray the sheriffs, police chiefs, prosecutors, and gun owners who may be exercising civil disobedience in the worst light possible, and their propaganda is likely to get even more ridiculous as the scale of their defiance becomes clear.\u00a0Though Filindra paints the history of this nation as a never-ending struggle between the forces of oppression and various underdogs, the fact remains that a complete and total ban on firearms has\u00a0<\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">never<\/span><\/em><span class=\"text-node\"> been enacted by the powers that be, no matter how reactionary they might have been, and even during times of widespread social and economic unrest or as the size and role of government has grown ever-larger. If she and other gun control fans want to paint the current fight in Illinois as part of an existential battle between the forces of good and evil, so be it, but I\u2019d say the side that\u2019s turning people into criminals for simply maintaining possession of guns and magazines they lawfully purchased are the villains of this story.<\/span><\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Looks Like There&#8217;s Massive Non-Compliance With Illinois Gun Registration The deadline for Illinois gun owners to register their banned \u201cassault weapons\u201d with the state police has come and gone, and contrary to the predictions of Gov.
