A firearm can\u2019t go from Point A to Point B without a mountain of paperwork, for example. About the only industry that can compete with it regarding the amount of regulation they deal with is the pharmaceutical industry.<\/p>\n<p>But a lot of people seem to think that the gun industry is unregulated.<\/p>\n<p>Now, this is usually not a big deal. It doesn\u2019t take much to show just how wrong people who think that actually are. We can usually show them how regulated guns actually are.<\/p>\n<p>Occasionally you\u2019ll find someone who should know better but, apparently, doesn\u2019t. An example is this guy who seems to think that toy guns are regulated more than real firearms.\u00a0<a href=\"https:\/\/www.theregreview.org\/2024\/01\/11\/mcdonald-rethinking-firearms-regulation\/\" target=\"_blank\" rel=\"noopener\">He also thinks that should change<\/a>.<\/p>\n<blockquote><p><span style=\"font-size: 12pt;\"><strong>What if the United States regulated real firearms as stringently as they regulated toy guns for children?<\/strong><\/span><\/p>\n<p><span style=\"font-size: 12pt;\"><strong>In a forthcoming\u00a0<a href=\"https:\/\/deliverypdf.ssrn.com\/delivery.php?ID=094105095110071009003086082019111024001033030064027066098109071088068012091005007071020045051127023056111100106027079085114068107001090050083103107086100095104108120036022056002078017085115122099127000016097089123096029077123024014106081024109086126119&amp;EXT=pdf&amp;INDEX=TRUE\" target=\"_blank\" rel=\"noopener\">article<\/a>,\u00a0<a href=\"https:\/\/www1.villanova.edu\/villanova\/law\/academics\/faculty\/Facultyprofiles\/bencavataro.html\" target=\"_blank\" rel=\"noopener\">Benjamin Cavataro<\/a>, a professor at the\u00a0<a href=\"https:\/\/www1.villanova.edu\/university\/law.html\" target=\"_blank\" rel=\"noopener\">Villanova University Charles Widger School of Law<\/a>, proposes that Congress empower the\u00a0<a href=\"https:\/\/www.cpsc.gov\/\" target=\"_blank\" rel=\"noopener\">Consumer Product Safety Commission<\/a>\u00a0(CPSC) to regulate guns in the same way that it regulates other consumer products, such as toys.<\/strong><\/span><\/p>\n<p><span style=\"font-size: 12pt;\"><strong>Cavataro\u00a0<a href=\"https:\/\/deliverypdf.ssrn.com\/delivery.php?ID=094105095110071009003086082019111024001033030064027066098109071088068012091005007071020045051127023056111100106027079085114068107001090050083103107086100095104108120036022056002078017085115122099127000016097089123096029077123024014106081024109086126119&amp;EXT=pdf&amp;INDEX=TRUE\" target=\"_blank\" rel=\"noopener\">argues<\/a>\u00a0that empowering the CPSC to regulate guns would increase their safety without encroaching on politically charged issues such as gun access and prevalence.\u2026<\/strong><\/span><\/p>\n<p><span style=\"font-size: 12pt;\"><strong>Cavataro\u00a0<a href=\"https:\/\/deliverypdf.ssrn.com\/delivery.php?ID=094105095110071009003086082019111024001033030064027066098109071088068012091005007071020045051127023056111100106027079085114068107001090050083103107086100095104108120036022056002078017085115122099127000016097089123096029077123024014106081024109086126119&amp;EXT=pdf&amp;INDEX=TRUE#page=16\" target=\"_blank\" rel=\"noopener\">notes<\/a>\u00a0that subsequent efforts to introduce product safety regulations have fallen short because product safety measures for firearms are often seen as \u201cgun control.\u201d Cavataro\u00a0<a href=\"https:\/\/deliverypdf.ssrn.com\/delivery.php?ID=094105095110071009003086082019111024001033030064027066098109071088068012091005007071020045051127023056111100106027079085114068107001090050083103107086100095104108120036022056002078017085115122099127000016097089123096029077123024014106081024109086126119&amp;EXT=pdf&amp;INDEX=TRUE#page=17\" target=\"_blank\" rel=\"noopener\">contends<\/a>\u00a0that this characterization is misleading. Instead, he distinguishes between product safety measures, which seek to protect firearm users from dangerous mishaps, and gun control efforts, which seek to regulate the possession and use of guns.<\/strong><\/span><\/p><\/blockquote>\n<p>Wrong.<\/p>\n<p>What we\u2019re seeing here is a call for a bureaucracy to oversee the gun industry, ostensibly to maintain safety standards, which might be fine for many if we could trust the bureaucracy to end there. After all, making sure you guns work as they\u2019re supposed to wouldn\u2019t be a bad thing, if you\u2019re inclined to believe the government can do that job properly.<\/p>\n<p>But the reason people call these efforts \u201cgun control\u201d isn\u2019t due to a lack of understanding or mischaracterization. It\u2019s because we know damn good and well where such a body would eventually take their regulatory efforts.<\/p>\n<p>Think for a moment how the ATF started as a revenue collection agency and now is deciding what is legal and what isn\u2019t. We\u2019ve seen federal agencies try to say their ability to regulate waterways\u00a0<a href=\"https:\/\/reason.com\/2023\/05\/25\/supreme-court-reins-in-epa-overreach\/\" target=\"_blank\" rel=\"noopener\">included mud puddles<\/a>.<\/p>\n<p>Now think about the\u00a0<a href=\"https:\/\/bearingarms.com\/tomknighton\/2023\/11\/30\/assault-weapon-bill-2-n77874\" target=\"_blank\" rel=\"noopener\">GOSAFE Act<\/a>\u00a0for a second. This is, in essence, an attempt to regulate the gun industry. It\u2019s not through a regulatory body, which means it has to battle through Congress to become law.<\/p>\n<p>And a lot of people are opposed to it.<\/p>\n<p>Yet if we had a regulatory body over the gun industry, the defeat of such a bill would only be part of what\u2019s necessary. We\u2019d then have to defeat that regulatory body when it attempted to put similar rules in place.<\/p>\n<p>We call it gun control not because we don\u2019t understand but because we understand all too well what will happen.<\/p>\n<p>That\u2019s not going to change.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Call for Regulation of Gun Industry Has Faulty Premise The gun industry is one of the most regulated industries in the nation.
