{"id":99667,"date":"2024-01-30T01:50:38","date_gmt":"2024-01-30T07:50:38","guid":{"rendered":"https:\/\/milesfortis.com\/?p=99667"},"modified":"2024-01-30T01:50:38","modified_gmt":"2024-01-30T07:50:38","slug":"99667","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=99667","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/www.printfriendly.com\/p\/g\/hTXiqx\" target=\"_blank\" rel=\"noopener\">New Mexico Senator Can&#8217;t Defend Waiting Period Bill, Predicts SCOTUS Will Reverse Itself on Bruen Instead<\/a><\/p>\n<div class=\"container d-flex flex-column pf-app-wrapper justify-content-start\">\n<div class=\"d-flex flex-row pf-app-row flex-auto\">\n<div class=\"pf-app-inner d-flex flex-column pf-app-shadow\">\n<div id=\"pf-body\" class=\"browser pf-content-wrapper px-2 px-sm-4 px-md-5 pt-2 pt-sm-3\">\n<div id=\"printfriendly\" class=\"print-only\">\n<div>\n<div id=\"pf-print-area\" class=\"clearfix js-print-area content-unmask direction-ltr\">\n<div id=\"pf-content\" class=\"js-pf-content pf-12\">\n<div id=\"\" class=\"\">\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">The gun control bills are flying in Santa Fe as anti-2A lawmakers are racing to enact a flurry of new restrictions on residents; a sweeping semi-auto ban, prohibiting gun sales to adults younger than 21, and enacting a new 14 business-day waiting period on all firearms transfers that would be the longest in the nation. Unlike last session, where similar bills were bottled up in committee or voted down altogether, Democrats this year seem willing to go along with virtually every restriction demanded by Gov. Michelle Lujan Grisham, even as they tacitly admit that their bills are going to run into trouble in the courts if they\u2019re enacted into law.<\/span><\/p>\n<div class=\"thm-piano-mop-premium\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">When State Sen. Joe Cervantes was questioned about that potential 14 business-day waiting period during a meeting of the Senate Health and Public Affairs Committee over the weekend, the anti-gun lawmaker studiously avoided answering a query from a colleague about whether that waiting period comports with the national tradition of gun ownership in the United States. Instead, he\u00a0<\/span><a href=\"https:\/\/sg001-harmony.sliq.net\/00293\/Harmony\/en\/PowerBrowser\/PowerBrowserV2\/20240127\/-1\/74510\" target=\"_blank\" rel=\"noopener\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">proclaimed<\/span><\/a><span class=\"text-node\">\u00a0that the Supreme Court is going to overrule its own decision in\u00a0<\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Bruen\u00a0<\/span><\/em><span class=\"text-node\">in just a few months, making any potential conflict with the \u201ctext, history, and tradition\u201d test laid out in that case utterly moot.<\/span><\/p>\n<blockquote data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span style=\"color: #000000;\"><strong><span class=\"text-node\" style=\"font-size: 12pt;\">\u201cIt\u2019s an absurd ruling. And it\u2019s an absurd ruling that will not stand, I believe, for the next six months because the Supreme Court will reverse itself and recognize the absurdity of Clarence Thomas\u2019s opinion. <\/span><\/strong><\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span style=\"color: #000000;\"><strong><span class=\"text-node\" style=\"font-size: 12pt;\">Now, that sounds pretty arrogant of me, a Las Cruces street lawyer, to say that the Supreme Court wrote an absurd opinion, but I\u2019m going to stand by that. And I\u2019ll give you an example: Clarence Thomas, with the majority, held that any restrictions on guns had to be based on historic traditions, yet we as a country do not allow guns in this capitol. <\/span><\/strong><\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span style=\"color: #000000;\"><strong><span class=\"text-node\" style=\"font-size: 12pt;\">Some of you may disagree with that, but there\u2019s no historical tradition about not allowing guns in government buildings.<\/span><\/strong><\/span><\/p>\n<\/blockquote>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Cervantes went on to say that there\u2019s no historic tradition banning fully automatic firearms or rocket-propelled grenades or prohibiting the mentally ill or convicted felons from possessing firearms, arguing that the Court will have no choice but to reverse itself when it issues its decision in\u00a0<\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Rahimi<\/span><\/em><span class=\"text-node\">, which deals with the federal prohibition on gun ownership for those subject to a domestic violence restraining order.<\/span><\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<p data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><!--more--><\/p>\n<div class=\"container d-flex flex-column pf-app-wrapper justify-content-start\">\n<div class=\"d-flex flex-row pf-app-row flex-auto\">\n<div class=\"pf-app-inner d-flex flex-column pf-app-shadow\">\n<div id=\"pf-body\" class=\"browser pf-content-wrapper px-2 px-sm-4 px-md-5 pt-2 pt-sm-3\">\n<div id=\"printfriendly\" class=\"print-only\">\n<div>\n<div id=\"pf-print-area\" class=\"clearfix js-print-area content-unmask direction-ltr\">\n<div id=\"pf-content\" class=\"js-pf-content pf-12\">\n<div id=\"\" class=\"\">\n<div class=\"thm-piano-mop-premium\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">\u201cWhen you take the Supreme Court\u2019s argument to its natural conclusion and say there has to be a historic tradition to limit guns, it\u2019s an absurd decision, and the Supreme Court\u2019s going to recognize that pretty quickly.\u201d<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">While the Court may very well conclude that Zackey Rahimi should not have been allowed to possess a firearm after a domestic violence restraining order was granted, I don\u2019t think the justices are going to have to invalidate\u00a0<\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Bruen\u00a0<\/span><\/em><span class=\"text-node\">to do so. Instead, I suspect that if the justices rule against Rahimi, they won\u2019t backtrack on\u00a0<\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Bruen\u00a0<\/span><\/em><span class=\"text-node\">but will instead talk about a national tradition restricting gun ownership by individuals deemed to be \u201cdangerous\u201d; something that would allow them to deny Rahimi his ability to possess a firearm while leaving the door open to challenges from individuals like Bryan Range, who became a prohibited person after he was convicted for falsifying his income on an application for food stamps several decades ago.<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Neither\u00a0<\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Range\u00a0<\/span><\/em><span class=\"text-node\">nor\u00a0<\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Rahimi\u00a0<\/span><\/em><span class=\"text-node\">have anything to do with waiting periods, but the issue\u00a0<\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">has\u00a0<\/span><\/em><span class=\"text-node\">come up in the courts since the\u00a0<\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Bruen\u00a0<\/span><\/em><span class=\"text-node\">decision was handed down. Of most importance to the bill authored by Cervantes, a federal judge in Colorado\u00a0<\/span><a href=\"https:\/\/www.cpr.org\/2023\/11\/14\/colorado-keeping-three-day-gun-law\/\" target=\"_blank\" rel=\"noopener\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">denied an injunction<\/span><\/a><span class=\"text-node\">\u00a0against a three-day waiting period last November, ruling that the Second Amendment doesn\u2019t cover the commercial sale of firearms. U.S. District Judge John L. Kane, Jr. bizarrely argued that the \u201cpurchase and delivery of an object (here, a firearm) is not an integral element of keeping (i.e., having) or bearing (i.e., carrying) that object,\u201d even though if you can\u2019t take possession of that firearm in a timely manner there\u2019s no way for you to keep or bear it.<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">The Supreme Court, on the other hand, specifically noted in\u00a0<\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Bruen\u00a0<\/span><\/em><span class=\"text-node\">that \u201clengthy wait times in processing license applications\u201d could lead to constitutional challenges of \u201cshall-issue\u201d carry regimes, which would suggest that lengthy wait times in acquiring a firearm would also be problematic from a constitutional perspective. A 14 business-day waiting period is not only an outlier from the perspective of our national tradition of gun ownership, but contrary to even modern federal gun laws. It\u2019s the National\u00a0<\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Instant\u00a0<\/span><\/em><span class=\"text-node pf-delete\">Check System, after all, not the National Three Day Waiting Period System. Transactions can be placed on hold for up to 72 hours while a check is being conducted, or up to ten business days if the purchaser is under the age of 21, but those are still exceptions. The standard is for those checks to be as close to \u201cinstant\u201d as possible for as many gun owners as possible, as opposed to Cervantes\u2019 blanket waiting period on all firearm transfers in the state.<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">The senator can proclaim\u00a0<\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Bruen\u00a0<\/span><\/em><span class=\"text-node\">to be an absurd decision all he wants, but that doesn\u2019t change the fact that it\u2019s still the guiding bit of jurisprudence when dealing with modern gun laws. And based on\u00a0<\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Bruen<\/span><\/em><span class=\"text-node\"> and the test it outlined, a 14-day waiting period isn\u2019t going to pass constitutional muster unless a judge like Kane contorts the text, history, and tradition test to\u2026 well, the point of absurdity. The sad thing is that, so far anyway, Cervantes has convinced his fellow Democrats to go along.
