Hunter Biden is charged under that same law in a federal court in Delaware.<\/em><\/p>\n<p class=\"_1uhbe1z1 _1uhbe1z0\">The 10<sup>th<\/sup>\u00a0Circuit Court of Appeals, which includes Wyoming, on Friday upheld a federal law barring drug users from possessing guns.<\/p>\n<p class=\"_1uhbe1z1 _1uhbe1z0\">The appeals court didn\u2019t say that the statute, 18 USC 922(g)3, is altogether constitutional,\u00a0just that a lower court judge was wrong to proclaim it unconstitutional in this case.<\/p>\n<p class=\"_1uhbe1z1 _1uhbe1z0\">This decision comes after the Fifth Circuit Court of Appeals chipped away at the law in a separate case by saying it unconstitutionally denied a marijuana user\u2019s Second Amendment rights. That case is now before the U.S. Supreme Court.<\/p>\n<p class=\"_1uhbe1z1 _1uhbe1z0\">Hunter Biden, President Joe Biden&#8217;s son, is charged with that same law in a Delaware federal court. His case is ongoing.<\/p>\n<p><!--more--><\/p>\n<h2 class=\"_1uhbe1z1 _1uhbe1z0\"><strong>Sorry, No<\/strong><\/h2>\n<p class=\"_1uhbe1z1 _1uhbe1z0\">The Colorado-based 10<sup>th<\/sup>\u00a0Circuit Court of Appeals, which also encompasses Wyoming, on Friday rejected Utah federal District Court Judge Jill Parrish\u2019s June 2022 ruling deeming the drug-user and guns law unconstitutional.<\/p>\n<p class=\"_1uhbe1z1 _1uhbe1z0\">The appeals court\u2019s Friday ruling has two main parts:<\/p>\n<div><\/div>\n<p class=\"_1uhbe1z1 _1uhbe1z0\">First, the higher court said Parrish was wrong to allow a full constitutional challenge against the law in the first place. She should have determined, rather, whether the law was unconstitutional only as charged against this particular drug user, Jonathan Alexander Morales-Lopez.<\/p>\n<p class=\"_1uhbe1z1 _1uhbe1z0\">That doesn\u2019t bar future constitutional challenges against 922(g)3,\u00a0it just corrects what this appeals court saw as the wrong approach to reviewing it.<\/p>\n<p class=\"_1uhbe1z1 _1uhbe1z0\">Secondly, the appeals court took it a step further and declared that the law was applied constitutionally to Morales-Lopez, and his guilty verdict should be reinstated.<\/p>\n<div>\n<div id=\"container-s14ruwg2uzk0000000000\" class=\"bsa-ad-type-high-resolution-ad\">\n<div id=\"s14ruwg2uzk0000000000\"><strong style=\"font-size: 28px;\">Drug User And Gun<\/strong><\/div>\n<\/div>\n<\/div>\n<p class=\"_1uhbe1z1 _1uhbe1z0\">Morales-Lopez was found near 5.7 grams of methamphetamine and carrying a stolen gun when arrested in 2020. He\u2019d been acting as lookout while his friend robbed a Sportsman\u2019s Warehouse in Midvale, Utah.<\/p>\n<p class=\"_1uhbe1z1 _1uhbe1z0\">While Moralez-Lopez didn\u2019t admit to using the methamphetamine officers found in their police car after his arrest, he did admit to using drugs one month earlier.<\/p>\n<p class=\"_1uhbe1z1 _1uhbe1z0\">His attorney argued to the appeals court that this laid a murky evidence base for trying to convict a man who may not have used drugs recently. The attorney questioned when, if ever, a person would be able to buy a gun after eating a cannabis edible.<\/p>\n<h2 class=\"_1uhbe1z1 _1uhbe1z0\"><strong>Meth, Though<\/strong><\/h2>\n<p class=\"_1uhbe1z1 _1uhbe1z0\">The appeals court countered, saying it looks like Morales-Lopez was still a user at the moment of his arrest.<\/p>\n<p class=\"_1uhbe1z1 _1uhbe1z0\">\u201cThe elephant in the room is the 5.7 grams of methamphetamine (found in the police car with him),\u201d reads the Friday ruling. \u201cAnd what was Defendant\u2019s reason for possessing the methamphetamine?\u201d<\/p>\n<p class=\"_1uhbe1z1 _1uhbe1z0\">The other evidence by which the appeals court inferred that Morales-Lopez was still a \u201cuser\u201d was:<\/p>\n<ul class=\"_1uhbe1z1 _1uhbe1z0\">\n<li>Morales-Lopez\u2019s habit of using drugs and meeting up with drug dealers as recently as a month before.<\/li>\n<li>His being arrested for the theft with a man with whom he\u2019d used drugs in the past.<\/li>\n<li>Police officers\u2019 discovery of drugs in Morales-Lopez\u2019s accomplice\u2019s car.<\/li>\n<\/ul>\n<h2 class=\"_1uhbe1z1 _1uhbe1z0\"><strong>Criminals Can\u2019t Challenge This One<\/strong><\/h2>\n<p class=\"_1uhbe1z1 _1uhbe1z0\">The appeals court said that because the law was constitutional as applied to Morales-Lopez, it wasn\u2019t his business to claim it was unconstitutionally vague altogether.<\/p>\n<p class=\"_1uhbe1z1 _1uhbe1z0\">How the law applies to everyone else shouldn\u2019t be Morales-Lopez\u2019s concern when the law fairly convicted him, the ruling adds.<\/p>\n<p class=\"_1uhbe1z1 _1uhbe1z0\">In fact, defendants generally can\u2019t challenge laws as unconstitutionally vague, \u201cexcept in those\u00a0<em>rare<\/em>\u00a0instances where a legislature has enacted a statute which is so totally vague as to \u2018proscribe no comprehensible course of conduct at all,\u2019\u201d says the ruling.<\/p>\n<p class=\"_1uhbe1z1 _1uhbe1z0\">But the ruling says 922(g)3 is not vague enough to trigger that exception.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>I can see a &#8216;Circuit Split&#8217; sometime in the near future&#8230;..
