NY gun proposal appears poised to adapt to Supreme Court decision
A Brooklyn lawmaker has proposed legislation that seeks to limit where firearms could be legally possessed, with a separate SCOTUS ruling upcoming.

NEW YORK — A Brooklyn lawmaker appears ready to adapt to a potential Supreme Court decision that could impact the process of getting a concealed carry license in New York.

Assembly Bill 8684 was introduced by Assemblymember Jo Anne Simon (D) back in January. It suggests placing limits on where firearms can be possessed including most public transportation, food, and drink establishments and at gatherings of 15 people or more. The bill has no co-sponsors in either the State Senate or Assembly, which would be necessary to move it forward, but gun advocates and constitutional experts are already signaling the bill may not hold water.

“In most cases where individuals have a constitutional right officials are not allowed to have discretion whether you’re able to exercise that right,” explained 2 On Your Side Legal Analyst Barry Covert.

Biden: Wait Another Month or So to See if Sanctions Are Working.

In yet another… uneven press conference appearance, President Biden’s worst line was, “they are profound sanctions. Let’s have a conversation in another month or so to see if they’re working.”

It’s not clear that President Volodymyr Zelensky, the Ukrainian government, and the Ukrainian armed forces have another month. Russian and Ukrainian forces are fighting over control of Antonov Airfield, just 15 minutes from Kyiv. The Ukrainians are trying to hold off the Russians at Hostomel airport outside Kyiv. The Russian forces are attempting to secure Kyiv as quickly as possible – and if the Russians get control of those airfields, they can fly in a lot more reinforcements.

This assessment from a former U.S. Army infantry officer suggests the Ukrainians could hold out in the cities for a long while. But it’s anyone’s guess as to how the battles, large and small, play out from here. It is quite possible that time is indeed on the Ukrainians’ side; there’s at least one report indicating that a group of Russian forces surrendered when they realized the Ukrainians would fight back. Maybe Putin and the Russian military leadership severely underestimated the Ukrainian will to resist. But Russia can still bring a hell of a lot of ordinance down on any target. No one knows what the situation will look like tomorrow, much less a week or a month from now.

Economic sanctions don’t work particularly quickly; it takes time for Russians, from the oligarchs to the average citizen to feel the squeeze. Sanctions might have put real pressure on Putin’s allies — if they had been put in place a month ago.

President Biden said he wants to have a conversation in another month or so to see if sanctions are working. A month from now, there may not be much of a Ukrainian government left.

Russia-Ukraine: White House plays clean-up after Biden says ‘no one expected’ sanctions ‘to prevent anything’

The White House played clean-up Thursday evening after President Biden claimed “no one expected” sanctions to prevent Russian President Vladimir Putin from invading Ukraine, despite claiming for weeks that the mere threat of sanctions would serve as a deterrent effect.

White House deputy national security adviser Daleep Singh told reporters said that had the Biden administration “unleashed our entire package of financial sanctions preemptively,” Putin still likely would have invaded Ukraine.

“Number one, President Putin might have said, ‘Look, these people are not serious about diplomacy. They’re not engaging in a good-faith effort to promote peace, instead they’re escalating,’” Singh hypothesized. “And that could provide a justification for him to escalate and invade.

“Secondly, he could look at it as a sunk cost,” he continued. “In other words, President Putin could think, ‘I’ve already paid the price, why don’t I actually take what I paid for, which is Ukraine’s freedom.’ So that’s what we wanted to avoid.

“Ultimately, the goal of our sanctions is to make this a strategic failure for Russia,” he added. “Strategic success in the 21st century is not about a physical land grab of territory. That’s what Putin has done. In this century, strategic power is increasingly measured and exercised by economic strength, by technological sophistication, and your story – who you are, what your values are, can you attract good ideas and talent and goodwill? And on each of those measures this will be a failure for Russia.”

Earlier Thursday, Biden announced new sanctions on top of previous ones against Russia in response to its invasion of Ukraine, but he later admitted that “no one” expected the sanctions to prevent the invasion.

“No one expected the sanctions to prevent anything from happening,” Biden said. “This could take time, and we have to show resolve, so he knows what’s coming and so the people of Russia know what he’s brought on them, this is what this is all about.”

This appeared to go against Vice President Kamala Harris’ comments on Sunday that claimed, “The purpose of the sanctions has always been and continues to be deterrence.” On Feb. 11, national security advisor Jake Sullivan similarly claimed that “sanctions are intended to deter.” On Wednesday, White House Press Secretary Jen Psaki said, “deterrence is part of our objective.”

Biden stopped short of sanctioning Putin himself Thursday, and he did not announce a ban on Russia from the SWIFT banking system, saying Europe is not on board with such a move.

Constitutional Carry in doubt after Indiana committee guts legislation

The good news for Indiana gun owners is that Constitutional Carry legislation passed out of a key Senate committee on Wednesday. The bad news is that it’s no longer a Constitutional Carry bill.

HB 1077 had already passed out of the House with an overwhelming majority, but its future is very much in doubt in the state Senate after an eight-hour hearing of the Judiciary Committe left the bill stripped of its original intent.

As amended, House Bill 1077 would keep the permit requirement in place to carry a handgun in Indiana. However, it would enable qualified candidates who have applied for a permit to carry a handgun without a license until they receive their permit. The idea is that this would end complaints about delays in the permitting process.

The amendment to gut the bill just narrowly passed by a 6-5 vote, splitting the Republicans on the committee. Every Democrat voted to gut the bill. Shortly after, the committee unanimously voted to advance the bill to the floor. Some were unhappy with the bill, but voted to keep it moving.

Now, this doesn’t mean that Constitutional Carry is officially dead in the Indiana legislature. It’s possible that the bill will be amended once again to restore the permitless carry provisions once the legislation comes up for debate on the Senate floor, though many law enforcement agencies and gun control groups are going to continue their efforts to kill the bill, even if many of their arguments don’t make much (gun)sense.

Critics say there should be a vetting process.

“We will have people walking on our street never vetted by law enforcement, never receiving a background check with loaded firearms around our children,” Jennifer Haan with Moms Demand Action in Indiana said last month.

There are already people doing that right now in Indiana, and if they’re not legally allowed to own a gun they’re not legally allowed to carry it. That wouldn’t change under the Constitutional Carry language in HB 1077. The only difference would be that those who can legally possess a gun in their home could also lawfully carry it in public without the need for a government-issued permission slip.

Gun control activists weren’t the only ones making some odd arguments in opposition to the bill.

Officers also said individuals would have to background check themselves if the permit requirement was nixed, and might not know they aren’t qualified to carry a handgun. Detective Matt Foote from the Fort Wayne Police Department, said 14% of those who applied for permits in his community in 2021 were denied.

That’s actually already an issue. If you don’t know that you’re a prohibited person and you fail a NICS check, you could be charged with a crime for attempting to purchase a firearm (though under federal law prosecutors must prove that you knowingly tried to purchase a gun you weren’t allowed to possess). The responsibility of ensuring that you can lawfully carry already lies with the gun owner, and that wouldn’t change if HB 1077 became law.

Constitutional Carry still has a chance in Indiana this year, but if it’s going to get across the finish line gun owners and Second Amendment activists need to contact their senators and urge them to restore HB 1077 to its original intent when it reaches the Senate floor.

More than 20 states have already adopted Constitutional Carry, and none of them have seen any cause to repeal the law and return to requiring a license to carry (though every Constitutional Carry state with the exception of Vermont still maintains a “shall issue” licensing system for gun owners who want to be able to legally carry in states with reciprocity agreements). Indianans are no less responsible than the residents of Arizona, Texas, Oklahoma, Utah, West Virginia, and the other states that have permitless carry laws already in place. The big question now is whether Indiana lawmakers are as supportive of the 2A rights of residents as their counterparts in nearly half of the states across the nation.

Bad arguments in favor of gun control persist

For proponents of gun control, there are tried and true arguments they trot out whenever they need them, and by “tried and true” I mean “tired and wrong.”

Over and over again, we see these arguments used, with almost no pushback from the mainstream media. After all, they’re the ones making these arguments.

Take this op-ed from the Star Tribune:

Gun regulation long has been the third rail of American politics. But the increase in murders, accidental shootings, suicides, armed carjackings and robberies, as well as the ongoing tragedy of mass shootings, shows the urgency of changing course. A responsible gun safety regulatory system would reduce crime and save lives.

Consider how we regulate cars. There are lawful uses for both guns and cars, but both are deadly when misused.

With cars, we require operators to be trained and licensed. We register every vehicle, and re-register each when it’s transferred to a new owner. We require liability insurance. We also require safety modifications and regulate how and where cars are driven.

Except that’s an inaccurate comparison. You only have to do any of that if you drive the vehicle on a public road. If you keep it confined to your farm, you’re not required to do any of that.

Further, the right to keep and bear arms is a constitutionally protected right. Cars, not so much. The courts have ruled that driving is a privilege, not a right, so comparing regulations surrounding a privilege to the lack of regulations for a right isn’t asinine, it’s idiotic.

But it’s bound to get better, right?

Don’t hold your breath.

For guns, there is no licensing, no training requirement, no registration, no insurance, no safety equipment required. This enables criminals to obtain guns with no background check, no waiting period — no means of enforcement at all.

Except that every FFL holder conducts criminal background checks on every firearm they sell.

“Oh, but private sales-”

Sure, in theory, but do you know how criminals tend to get guns? Via the black market, which is never going to conduct a criminal background check. Remarkably few buy from law-abiding gun owners looking to lawfully sell a firearm, so it’s a non-issue.

Yet the hits don’t stop there. Oh no, we get this classic gem:

The U.S. Constitution explicitly says “well-regulated” when referring to gun rights, yet the gun lobby opposes any form of gun regulation. The courts have said that reasonable restrictions may be placed on the possession of firearms. The National Firearms Act of 1934 effectively banned machine guns from most private ownership. Since that time, the “Tommy guns” of the Al Capone era and other fully automatic machine guns have not been used in mass killings or other crimes.

Oh, goodie, the “well-regulated” argument.

Talk about nonsense.

Look here, Sport. The phrase “well-regulated” meant nothing more than “properly functioning,” such as a well-regulated clock. The term didn’t mean then what it means now and there’s been a lot of actual scholarship supporting that fact.

Plus, more importantly, the right explicitly says “the right to keep and bear arms shall not be infringed.” That’s a contradictory clause unless “well-regulated” meant something differently at the time. It’s unlikely such a contradictory amendment would have been added by our Founding Fathers who desperately were trying to build a nation of laws.

But the author doesn’t care about that. He just wants to see new gun control passed, claiming it saves lives. Except, a look at the UK’s homicide rate before and after they passed gun control shows that it doesn’t really.

So not only are his arguments bad, even the facts work against him.

How Joe Biden Created The Ukraine Crisis.

The liberal media won’t admit it, but the reason Russian forces are entering Ukraine can be explained in two words—Joe Biden. In fact, thanks to Biden, the U.S. is paying for the Russian invasion. His energy policy of reducing American production, stopping the almost completed keystone pipelines, no drilling on federal lands, new regulation regarding oil and gas drilling, and much more spiked the price of energy. For example, in 2020 the price of natural gas was $4.36/1,000 cubic feet, 2021 prices averaged $9/1,000 cubic feet.

Before Biden became President, the U.S. was energy independent and an exporter of energy. The lower American production and removing Trump’s restrictions on the Nordstream natural gas pipeline from Russia to Germany. His policies made other countries more reliant on Russian gas. Giving Putin leverage on other countries such as Germany and doubling the price. All that extra money went straight into Russia’s pockets. Those new profits helped Russia raise the funds to continue Putin’s dream of the greater Russia of the USSR.

On top of the higher prices and the increased dependence on Russian energy, the mishandling of the Afghan withdrawal and removing some of the Iran sanctions showed Biden to be a weak President. Putin is no idiot. All of Biden’s flawed policies and feeble foreign policy made the Russian president understand that if he was ever going to get Ukraine back in Russia’s clutches, this was it.

San Francisco residents report police doing nothing

During the push to “defund the police,” San Francisco was knee-deep in things. In fact, while few places actually reduced police funding, they did.

Eventually, due to soaring crime, the city reversed that. They really didn’t have a choice at that point.

However, it doesn’t seem to be helping. Why? Because the police don’t seem interested in actually arresting anyone.

After weeks battling the bewildering bureaucracy of San Francisco’s criminal justice system, Danielle Kuzinich finally has some answers in the strange case of the thrashed parklet and the do-nothing cops.

Just before dawn on Dec. 31, firefighters witnessed a man wrecking the charming parklet outside the San Francisco Wine Society in the Financial District and notified police. Security camera footage from a nearby hotel shows police arriving, chatting with a firefighter, talking to a man sitting next to piles of parklet debris and leaving. It then shows the man continuing to trash the area.

Now, a man police believe is the culprit is in jail — busted only because he allegedly went on to commit more vandalism days after the Wine Society mess. But the episode spotlighted an issue bigger than one arrest: a pattern of some officers on the San Francisco force seemingly uninterested in dealing with crime.

Numerous readers shared stories of police indifference after reading last week’s column about Kuzinich’s frustrating experience — and how it adds to their feeling that San Francisco city government, and its criminal justice system in particular, is broken.

They had questions. Is property crime in some ways allowed in our city? Are police on an unofficial strike or work stoppage?

In a visit to The Chronicle newsroom Tuesday, Police Chief Bill Scott promised that’s not the case.

“I can confidently say that’s not happening,” he said. “I get a report every morning of last night’s activities, and there’s a lot of great work being done.”

Not officially, in any case.

However, if this is a recurring problem, there’s probably a reason for it. Scott knows this, too.

He acknowledged, though, that the department has “serious morale issues” because of understaffing, intense scrutiny amid the police reform movement and tussles with District Attorney Chesa Boudin. Still, he said, that’s no excuse for not addressing crime.

“Despite the reason that an officer may be in that mental state where they might think it’s not a big deal for them to bother with it, it is a big deal,” Scott said. “And when they don’t do their job, I have to hold them accountable.”

The problem, though, is that they were thrown under the bus for something that didn’t even happen in their city.

Following the death of George Floyd during an arrest, departments all over the nation felt the heat. A few, like San Francisco, saw their funding cut by politicians who were essentially blaming them for something that happened in Minneapolis.

As a result, one shouldn’t be surprised when the police are less inclined to engage with someone committing a crime.

After all, any criminal offense can result in someone dying under certain circumstances. Is it any wonder that these guys would opt not to do much?

I’m not excusing it, mind you, just understanding it. They’re paid to do a job and they’re supposed to do it. Failure to do that should result in some degree of punishment. That’s simply not a matter up for debate in my book.

But the leadership in San Francisco needs to accept their own role in this. They need to understand that while the officers on the street need to step up, they’re not doing so as a result of their own actions.

Police officers aren’t mindless myrmidons who simply do as they’re told without thought or feeling. They’re people who are trying to do the best they can in most cases, and they don’t appreciate being vilified by their own leadership.

Psaki Pushes Chinese Propaganda From White House Podium.

White House press secretary Jen Psaki on Tuesday claimed that the spike in violence against Asians in the United States was due to “hate-filled rhetoric” about the origins of the coronavirus pandemic, a baseless claim that has been promoted by the Chinese Communist Party.

“We’ve seen this rise, unfortunately, because of hate-filled rhetoric and language around the origins of the pandemic,” Psaki said from the briefing room in response to a question on the 339 percent increase in anti-Asian hate crimes since President Joe Biden took office last January.

Psaki is not the first to push the unsubstantiated link between speculation about how the coronavirus emerged in Wuhan, China, and violence toward Asians. Allegations of that unfounded link grew to a fever pitch last spring and were trumpeted during #StopAsianHate rallies across the country. A Wall Street Journal investigation found, however, that the driving force behind the rallying call was a network of fake social media accounts driven by the Chinese government as it pushed to undermine the plausible “lab-leak” theory.

Canadian Public Safety Minister Claims, Without Proof, That Protestors Were Really Violent Terrorists Attempting to Overthrow Canadian Government.

Worth watching this entire diatribe from start to finish.  In his public statements today, Trudeau’s Public Safety Minister, Marco Mendicino, definitively says the people charged by federal RCMP officials are tied to far-right extremist groups who are funded by international terrorist organizations with an intent to overthrow the government.

According to the statements, the Canadian government is under attack from thousands of highly organized terrorists within the country.  Their goal is to overthrow the government and install an entirely new form of national assembly.  This is what he is claiming.

Specifically, Mendicino claims the protestors, charged with firearms offenses in Coutts, are the first wave of a well known domestic terrorist group directly connected to the trucker protest group in Ottawa.  However, when challenged to give the name of the terrorist organization he is speaking about, Mendocino completely walks back the claim to an unrecognizable point.

You can always tell when SloJoe’s failing hard drive is rebooting; he says that magic word: “Look.” And remember, all he has to do is read off the screen of a teleprompter, and he can’t even manage that.

BLUF:
I’m not suggesting Biden’s rhetoric means he actually wants a war. Anyone proclaiming that is outthinking themselves. There is no situation where the Democrat Party doesn’t get utterly destroyed domestically if a war breaks out in Europe on their watch. Rather, what we are seeing is a president who just doesn’t have anything better to offer. This “cry wolf” strategy is the best he’s got.

Joe Biden Makes a Big Announcement on Ukraine That Only Raises More Questions About His Competency

Joe Biden arrived 55 minutes late today to give a short presser on the ongoing crisis between Russia and Ukraine. Following his comments, the president then took only three, pre-selected questions, before leaving for what I’d assume is another long weekend of naps and pudding.

Is that the kind of effort you’d expect from a man supposedly trying to defuse a major incursion into Europe? Probably not, but it’s what we’ve come to expect from Biden, perhaps the least hard-working president in American history.

Still, despite his concerning physical appearance and seeming drowsiness, Biden did manage to say a few things of note in the presser. Namely, he is once again proclaiming that a Russian invasion of Ukraine will come in the “coming days.”

How many weeks does this make of the White House making this same proclamation? Remember when the invasion was going to happen before the Olympics? Then it was going to happen a week ago, when the United States evacuated its embassy. Then the Russians were going to attack on Wednesday. That day came and went like those before it — without incident.

I’m not saying Russia won’t eventually invade. In fact, I think it’s more than likely at this point in time. What I am saying is that it makes the United States look weak and incompetent to keep making these predictions and have them not come true.

Biden Snaps at Reporter and Rejects Reality in Acid Bath of an Interview

The Biden team has indicated they think the problem with Joe Biden’s approval numbers is just a messaging problem, that he needs to get out more in the public and talk more, even as they do all they can to cut off the media from questioning him. But when they do let him out, as they did to do an interview with NBC News’ Lester Holt, they always have cause to regret it — because it’s an acid bath.

Holt asked him a number of questions on a variety of subjects.

Biden told him he wouldn’t send troops into Ukraine to rescue Americans if Russia invaded Ukraine because that could trigger a “world war,” and “things could go crazy quickly.” He said there was no scenario in which he would send troops to rescue Americans. “There’s not. That’s a world war when Americans and Russia start shooting at one another.”

Yikes. Once again, even if you don’t want to trigger fighting with Russia, and even if you want Americans to get out now, you don’t say there are no circumstances in which you wouldn’t rescue Americans because you don’t want to face the Russians. That’s incredibly weak and problematic. Plus you’re basically signaling to the Russians not to worry about the possibility of hostilities with the U.S., if they invade while there are Americans still there, Joe Biden won’t do anything, so come in now. I can’t believe how incredibly ignorant Biden is.

“It’s not like we’re dealing with a terrorist organization,” Biden said. “We’re dealing with one of the largest armies in the world. It’s a very different situation and things could go crazy quickly.”

Biden added that if Russian President Vladimir Putin is “foolish enough to go in, he’s smart enough not to, in fact, do anything that would negatively impact on American citizens.”

Um, Biden left Americans at the hands of a terrorist organization in Afghanistan. Biden is basically saying that American safety would be up to Putin, not him; he’s out of it.

is – at best – disingenuous propaganda, as the 9th Circuit Court just recently overturned a District Court decision that ruled the California magazine ban was unconstitutional and this case hasn’t reached the Supreme Court for consideration yet. If that isn’t a ‘controversy’, I don’t know what is. So, the Washington State Attorney General merely confirmed he’s just another lying politician.

OLYMPIA — Today, the Washington state Senate passed Attorney General Request legislation sponsored by Sen. Marko Liias, D-Lynnwood, banning the sale of high-capacity magazines in Washington by a 28-20 vote. The bill prohibits the sale of magazines with a capacity of more than 10 rounds. This is the sixth session the Attorney General has proposed this legislation. Today’s vote marks the first time a limit on magazine capacity has passed a chamber of the Washington Legislature.

Senate Bill 5078 prohibits the sale, attempted sale and distribution of high-capacity magazines. It does not prohibit the possession of high-capacity magazines. The bill now heads to the House for consideration.

Beto’s about-face on AR-15s: “I’m not interested in taking anything from anyone”

Virtually every poll in the state of Texas shows Robert Francis “Beto” O’Rourke’s gubernatorial campaign is in serious trouble, but the biggest sign that the Democrat is failing to make inroads with Texas voters came on Tuesday, as O’Rourke was stumping for votes in Tyler.

Here we are in 2022, and suddenly O’Rourke has a very different message for Texas voters.

Speaking to reporters, O’Rourke also took a question about his controversial stance on guns and remarks made in 2019 about taking away AR-15s and AK-47s.

“I’m not interested in taking anything from anyone. What I want to make sure that we do is defend the Second Amendment,” he said. “I want to make sure that we protect our fellow Texans far better than we’re doing right now. And that we listen to law enforcement, which Greg Abbott refused to do. He turned his back on them when he signed that permitless carry bill that endangers the lives of law enforcement in a state that’s seen more cops and sheriff’s deputies gunned down than in any other.”

So the guy who said he was coming for our guns now claims he wants to defend the Second Amendment, yet in the same breath declares that protecting our right to keep and bear arms means criminalizing carrying a gun without a government permission slip? Does he actually think anyone is going to buy his supposed newfound respect for the Second Amendment when he keeps belittling it?

PRESIDENT BIDEN CALLS LAW-ABIDING AMERICANS ‘THE RESISTANCE’

President Joe Biden traveled to New York City for a media event to try and show America he’s doing something about rampant crime. Instead, he blamed the Second Amendment and lawful gun owners, said nothing about holding criminals to account and repeated the same tired lies about the firearm industry he keeps at the ready – lies “fact-checked” as being false each time he’s previously recited them.

It makes no difference to the president. He’s not even trying anymore. To President Biden and national gun control groups the problem is always the gun and the law-abiding members of the industry. It’s never the criminal.
